Renewal Application -Isidro Gonzalez, Inc. d/b/a Old Santa Fe <br />Mexican Grill -Hotel and Restaurant Liquor License - 994 Dillon Rd. <br />Rommelfanger called for any changes to the consent agenda. Mulvahill moved <br />the consent agenda be amended to move Item A -Renewal Application for The <br />Back Room Brewery to Authority Business Item VI B. Rommelfanger seconded. <br />Roll Call Vote: Mulvahill -yes, Wilson -yes, Carlson -yes, Rommelfanger -yes <br />and Gunning -yes. Wilson moved the remaining items of the Consent Agenda <br />be approved. Carlson seconded. Roll Call Vote: Rommelfanger -yes, Wilson - <br />yes, Carlson -yes, Mulvahill -yes and Gunning -yes. Consent agenda as <br />amended approved. <br />Authority Business <br />A. Evidence in Aggravation/Mitigation -Findings and Order -Show <br />Cause Hearing -The Back Room Brewery, Inc. d/b/a The Back Room <br />- Hotel and Restaurant Liquor License - 328 S. McCaslin Blvd. - <br />2/12/08 Incident <br />Attorney Light reminded the Authority this item was continued from the April 28, <br />2008 meeting when the Authority held a Show Cause Hearing and adopted a <br />motion finding sufficient evidence to support certain charges as stated in the <br />show cause order and directed the Authority Attorney to prepare a draft order of <br />findings of fact, conclusions of law, and final decision and order. He addressed <br />that order in the Authority packet. He asked the parties representing the City and <br />the Licensee to present evidence in aggravation and mitigation in the matter. <br />Stefan Fredericksmeyer, Special Prosecutor for the Louisville Local Licensing <br />Authority and Virginia Newman, Licensee, indicated they were ready to proceed. <br />Attorney Fredericksmeyerstated the person at Chili's picked upon the level of <br />intoxication of the party involved immediately and notified the police. He <br />questioned why The Back Room would not have noticed his level of intoxication. <br />He expressed concern the video tape of the evening was not provided for the <br />Authority. <br />Ms. Newman thanked the Authority for the ruling at the previous meeting. She <br />provided the Authority with the changes the bar has made, including looking for <br />qualified bartenders and hiring a bar manager. The timeline for getting the video <br />was laid out. She then expressed the impact of the suspensions on the business <br />to the Authority. <br />Discussion by the Authority centered on suspension, holding days in abeyance <br />and the impact on the business. <br />Mulvahill moved the Authority, based on the findings of fact and conclusions of <br />law, the Licensee's hotel and restaurant liquor license be suspended fora thirty- <br />
