The application includes <br />a request to allow carports to be constructed in a portion of the western parking <br />area roughly 11'-6" from the property line. <br />The plans include additional landscaping interest and buffering through shrubs in this <br />area, as well as a retaining wall, to mitigate the impact of the waiver request. Staff finds <br />there is no negative impact to the spirit and intent of the development plan criteria, and <br />that the waiver is warranted by the design and amenities incorporated into the <br />development plan. <br />Compliance with 17.28.120 <br />Section 17.28.120 of the Louisville Municipal Code lists 28 criteria for PUDs that must <br />be satisfied or found not applicable in order to approve a PUD.
