ITEM: <br />PLANNER: <br />APPLICANT: <br />OWNER: <br />LOUISVILLE PLANNING COMMISSION <br />STAFF REPORT <br />April 16, 2009 <br />Case #09-003-UR, a request for a Special Review Use (SRU) to <br />allow an outside patio dining area at the entrance of an existing <br />restaurant (Beef O'Brady's), located at 585 East South Boulder <br />Road. <br />Sean McCartney, Principal Planner <br />Village Square "BOB", 585 East South Boulder Road, Louisville, <br />CO 80027, Richard Womack, representative <br />Brasel LLC. <br />5770 South Beach Ct. <br />Greenwood Village, CO 80121 <br />Contact: Tim Brasel <br />PROJECT DESCRIPTION: <br />EXISTING ZONING: <br />LOCATION: <br />LEGAL DESCRIPTION: <br />TOTAL SITE AREA: <br />REQUEST: <br />CC — Commercial Community <br />585 East South Boulder Road, the restaurant located in the <br />northwest corner of the Safeway/Walgreen's shopping center. <br />Tract II Louisville North 7, Less .77 acres. <br />The property is approximately 3.18 acres, 138,521 SF. <br />Approval of Resolution No.03, Series 2009 approving a request for <br />a special review use to allow an outside patio dining area at the <br />entrance of an existing restaurant (Beef O'Brady's), located at 585 <br />East South Boulder Road. <br />BACKGROUND: <br />The applicant, Village Square "BOB", Richard Womack, has applied for a Special Review Use <br />(SRU) to authorize an outside eating area. The outside eating area is proposed for the front of <br />the 6,000 square foot restaurant, which is also used as the primary entrance. The patio would <br />also wrap around to the east side of the restaurant entrance for additional seating. <br />The intent of the applicant is to develop an outside patio connected to the front of the restaurant <br />for outside dining and drinking purposes. The applicant would utilize the existing concrete <br />flooring for the patio area and fence the patio with a 3 foot high wrought iron fence. The fencing <br />would be located between the existing columns, attached to the existing walls on either side. <br />The Louisville Municipal Code (LMC) does require that outdoor dining services be approved by <br />a Special Review Use (SRU). <br />Staff recommends that the outdoor dining area cease operation at 10 p.m. every night. <br />SUMMARY OF PROPOSAL / STAFF COMMENTS: <br />1 <br />
