Parking: <br />The restaurant achieves parking as part of a unified shopping center. The Village Square <br />Planned Unit Development (PUD), which was approved in 1978, established the center into 4 <br />phased tracts. Beef O'Brady's restaurant is located in Tract II, which provides 207 parking <br />spaces for approximately 33,200 square feet, for a parking ratio of 1 parking space for every 160 <br />square feet. The proposed improvements do not create additional building area and therefore do <br />not generate an additional parking requirement. No parking spaces will be removed for the <br />creation of this outdoor dining space. <br />Fencing: <br />The applicant is requesting to install a 3 foot high wrought iron fence, and gate, along the patio <br />dining area. The fence will outline the patio area, being placed in between the existing columns, <br />and attaching at each side of the building. <br />Placement of this fence will require approval of a building permit by the City of Louisville. <br />The Local Licensing Authority (LLA) will review the application on April 27, 2009 in <br />anticipation of BOA approval. <br />Landscaping: <br />The creation of the outdoor patio will not result in the removal of any existing landscaping, <br />however there isn't any additional landscaping being proposed in the creation of the outdoor <br />patio either. The applicant will use some existing planter boxes as landscaping treatments within <br />the patio areas. <br />Lighting: <br />The applicant is not proposing to provide any additional lighting for the patio dining area. The <br />applicant believes the existing lighting, which is inset lighting located under the existing cover, <br />is sufficient for the proposed outdoor eating area. <br />SPECIAL REVIEW USE CRITERIA: <br />Louisville Municipal Code § 17.40.100.A lists five criteria to be considered by the Planning <br />Commission in reviewing a Special Review Use application, which follow. The Planning <br />Commission is authorized to place conditions on their recommendation of approval, if they <br />believe those are necessary to comply with all of the criteria. <br />1. That the proposed use/development is consistent in all respects with the spirit and intent <br />of the comprehensive plan and of this chapter, and that it would not be contrary to the <br />general welfare and economic prosperity of the city or the immediate neighborhood; <br />The Comprehensive Plan (Plan) encourages a vibrant mix of land use to meet the needs of the <br />Louisville citizenry. Economic Development goals and objectives encourage the creation of <br />retail uses that capture the sales tax potential in the City of Louisville. Staff has not identified <br />any components of the application that we believe would be contrary to this criterion. <br />2. That such use/development will lend economic stability, compatible with the character of <br />any surrounding established areas; <br />2 <br />
