The applicant is requesting a re -plat of the Block 10 for the purpose of revising the location of the <br />access and utility easements to reflect their revised building layout. Because the Final Development <br />Plan did not include building placement on Block 10, there is no need to revise the Final <br />Development Plan. <br />The internal easements on the plat are as follows: <br />• 20' and 25'utility and access easement — throughout site <br />• 10' access and utility easement — on the southwestern portion of the property <br />• 10' waterline easement — from access easement to each building <br />• 20' waterline easement — from Snowberry Lane to internal access <br />It should be noted that the applicant's revision to their building layout will not result in an increase <br />to the number of units permitted on Block 10 (Planning Area #4), which was approved as 96 units. <br />Also, according to the attached Drainage Letter written by Jim Blankenship from JLB Consultants, <br />"the proposed development is in accordance with the North End — Anderson Final Drainage Report." <br />STAFF RECOMMENDATION: <br />The applicant is requesting a re -plat of the Block 10 of the North End Subdivision, to allow for the <br />relocation of the utility and access easements to match their proposed building layout. The <br />relocation of the easements will not result in the creation of additional land, nor the creation of <br />additional density (which is established for 96 units on Block 10). The easements are used primary <br />for internal access and utility placement. The revised access easements meet width and turning <br />radius requirements of the Louisville Fire District. <br />In a Drainage Letter written by Jim Blankenship of JLB Consultants, it is stated that the relocation of <br />the easements, which will eventually result in a new location for internal access drives, will not have <br />a detrimental affect on the approved "North End — Anderson Final Drainage Report". <br />According to the Public Works memorandum dated August 12, 2008, there are some elements that <br />need to be addressed prior to City Council review. Staff recommends that these elements be <br />addressed prior to the City Council Public Hearing. A copy of the memo has been attached for <br />Commission review. <br />Based on the above findings, Staff recommends approval of the re -plat of Block 10, with the <br />following condition: <br />1. The applicant must address all issues established in the August 12, 2008 memorandum from <br />Public Works, prior to the City Council Public Hearing. <br />PLANNING COMMISSION ACTION: <br />Resolution No. 16, Series 2008, recommending a re -plat of Block 10, of the North End Subdivision, <br />to allow a relocation of the existing utility and access easements, with one condition. The <br />Commission may approve (with or without conditions), continue or deny the request. <br />2 <br />
