0 0 <br />STAFF COMMENTS: <br />The Flood Insurance Rate Map (FIRM) calls out the elevation for the <br />100 year flood as being 5,320 feet above means sea level (MSL). <br />Property elevation taken at the southeast corner is 5,320.09. <br />City Code (Section 17.56.170(B.2) requires that the lowest <br />habitable floor be two (2) feet above the 100 year elevation. The <br />applicant has been advised by staff that the approximate required <br />elevation of the lowest habitable floor would be 5,322.09 ft. msl. <br />Given the property, elevation, it is anticipated that the applicant <br />will be able to comply with the required minimum elevation without <br />the need for significant filling. <br />As building plans have not been submitted, it has not been <br />determined if the proposed residence will have a basement. If a <br />basement is shown on the building plans, it would be limited to <br />storage only. Building permits would not be authorized for <br />basement finish as long as the property is determined to be in a <br />flood zone. <br />STAFF RECOMMENDATION: <br />Staff recommends approval of the request for the following reasons: <br />1. The Board of Adjustment has jurisdiction to authorize a <br />Special Exception Permit to construct a restricted use within <br />the flood regulatory district. <br />2. The permit, if authorized, will be consistent with the <br />objectives and purposes of the City of Louisville flood <br />regulatory standards. <br />3. The applicant is requesting to replace an existing 590 s.f. <br />residence. Replacement of the structure with a structure of <br />comparable square footage will not adversely affect the <br />storage capacity of the flood storage district. <br />4. The subject property is located within a flood storage <br />district. The proposed residence will be constructed at an <br />elevation which is in compliance the required building <br />elevations, per Section 17.56.190 C.2 of the LMC. <br />2 <br />
