Davidson asked for an estimate on how much the City had paid Public Service in the past five years <br />to underground and take down utility poles. <br /> <br />Tom Phare, Public Works Director, stated that it was pretty close to half a million dollars. <br />Davidson asked Jelinek to suggest wording for maintenance during off-hours. <br /> <br />Jelinek stated that the City would be better served by putting language in about the City's intent to <br />limit noise, lights, or disturbance to nearby residences or structures. <br /> <br />Davidson asked why they felt this ordinance was not in compliance with the Federal Communications <br />Act. <br /> <br />Jelinek stated that it is the limiting of the residential land uses. She clarified that computer or radio <br />equipment maintenance would be done at night, not construction. <br /> <br />Keany wondered if the City allowed an antenna to be installed on an existing power pole and the lines <br />are undergrounded at a later date, is the antenna grandfathered in and will the utility'pole have to be <br />left there? <br /> <br />Tanoue stated that it could be made a condition of the approval that at such time as the <br />undergrounding occurs, the approval expires. It could be made a condition of the approval. <br /> <br />Davidson called for anyone else in the audience who wished to speak on Ordinance No. 1264. <br />NONE <br /> <br />Davidson closed the public hearing and called for Council comments. <br /> <br />Mayer supported this ordinance unless someone came forward for technical reasons and a more <br />detailed analysis that shows why this creates a undue hardship on the industry. <br /> <br />Sisk felt it should be 24" from the wall for antennas and he was concerned about the seven mile <br />radius. He suggested a two mile radius. He agreed with Closser's statement about striking the first <br />part of the last sentence up to "....an affidavit that capacity will be available to other providers."in <br />17.42.060 of Section P. He suggested modifying it to allow maintenance between 7:30 a.m. and 9:00 <br />p.m. He also suggested putting in that this ordinance will not prohibit emergency services by the <br />providers. <br /> <br />Davidson suggested that wall mounted antennas be limited to 12" at the base and 24" at the top. <br /> <br />Lathrop suggested leaving the maintenance portion as is with the exception that maintenance could <br />be conducted at any time provided that there is no off-site disturbance after the stated hours. <br /> <br /> <br />
