6 <br /> <br />Louisville Local Licensing Authority <br />Meeting Date: May 8, 2000 <br /> <br />Authority Chairperson Myers asked members for a motion to grant or deny the application. <br /> <br />Member Jeffers motioned for the Local Licensing Authority of the City of Louisville to find that the <br />applicant is of good moral character, that the inhabitants of the neighborhood desire the license be <br />granted, that the license will meet the reasonable requirements of the neighborhood, that all City and <br />state law requirements have been met and that, based on these findings, the Local Licensing <br />Authority approve issuance of a hotel and restaurant license for White Lodging Services Corporation <br />and RI-LOU,LLC, doing business as Residence Inn by Marriott with the following conditions: 1. <br />That the licensed premises are redefined as shown onthe revised map, 2. That the applicant provides <br />adequate-personnel to monitor and control the licensed premises at all times alcoholic beverages are <br />served or consumed, and 3. The applicant will provide adequate signs to indicate where alcoholic <br />beverages are not allowed to be consumed outside the licensed premises. Seconded by Chairperson <br />Myers. Roll Call Vote: Evans - yes, Lipton - yes, Jeffers - yes, Myers - yes, Kimmett- yes. All <br />members were in favor, motion carried. <br /> <br />Bo <br /> <br />Transfer Application - Holly & Mike's Ribs, Inc., d/b/a Hickory Sticks Smokehouse & Grill <br />- Hotel & Restaurant Liquor License - 1000 South Boulder Road. <br /> <br />Chairperson Myers turned the transfer application review and questioning over to Authority <br />Attorney, Kathleen Kelly. <br /> <br />Attorney Kelly reminded the Authority that this item had been tabled at the April 24, 2000 regularly <br />scheduled meeting at the request of the attorney for the applicant. She reviewed with the members <br />that the transfer application is for a Beer and Wine license currently owned by David L. Woodard <br />and Barbara J. Woodard d/b/a Kaddy Shack. Attorney Kelly also noted that the transfer applicant <br />Holly & Mike's Ribs, Inc., d/b/a Hickory Sticks Smokehouse & Grill has been operating off a 120 <br />day temporary license originally issued November 16, 1999 and extended for an additional 60 days <br />on March 16, 2000. <br /> <br />The Authority Attorney stated that the burden of proof lies with the transfer applicant to meet the <br />requirements established by the State Statutes and Local Licensing Authority Rules and Procedures, <br />specifically Rule 5B. This rule requires the transfer applicant to provide proof of assent from the <br />current license holder. Attorney Kelly stated that pursuant to that rule no transfer should be approved <br />until substantial competent evidence is presented to the Authority demonstrating such assent. She <br />continued that a notarized statement by the current license holder would be evidence of such assent. <br />Attorney Kelly advised the Authority that such evidence has not been presented and that the attorney <br />for the transfer applicant was present to address this issue. <br /> <br />Attorney Kevin V. Moore, Esq., 8910 Ralston Rd. #202, Arvada, CO 80002 stated he is the attorney <br />of record for the transfer applicant Holly & Mike' s Ribs, Inc., d/b/a Hickory Sticks Smokehouse & <br />Grill. <br /> <br />Attorney Moore opened by stating agreement with the Authority Attorney's summary of the status of <br />the pending transfer application.
