Louisville Local Licensing Authority <br />Meeting Date: June 26, 2000 <br /> <br />DWAI is not a crime involving moral turpitude. <br /> <br />~amer -yes. <br /> <br />POLICE DEPARTMENT REPORT <br /> <br />A. Incident at Druids Arms <br /> <br />Sergeant Riggins reviewed the police reports filed 2/7/00, 3/1/00, 4/17/00, 5/3/00 and 5/21/00 <br />concerning incidents involving a male party, Two of the incidents involved the person being <br />contacted by police officers during routine bar checks in the Druids Arms establishment. The <br />individual was consuming alcohol, a violation of his bail bond terms. <br /> <br />There was brief discussion between members and Attorney Kelly concerning the definition of a <br />"habitual drunkard," current case law, and whether or not the licensed owner or agent of the <br />premises should know, or is obligated to know if a patron is subject to bond conditions which <br />prohibit a person from consuming alcohol. <br /> <br />Sergeant Riggins offered that since the definition and methods of prosecution lack any specific <br />guidelines, would the Authority consider testimony by experts trained to recognize such <br />offenders as evidence. <br /> <br />Chairperson Myers asked Sergeant Riggins if the bartender could be held accountable for service <br />to the patron in question and if the bartender had been informed by the officer not to serve <br />alcohol to the same patron. Riggins responded that the bartender could be cited if, and only if, <br />the officer gave the bartender a lawful order not to serve the person in question. He stated there <br />was no evidence in the report to indicate the officer gave such an order. <br /> <br />After further review of the police reports and discussion by members, it was determined that <br />there was not enough evidence to order a show cause hearing. <br /> <br />SECRETARY'S REPORT <br /> <br />Deputy City Clerk Bolte reviewed with the Authority the May 26, 2000 letter from the State of <br />Colorado, Liquor Enforcement Division outlining fee increases for all new applications, transfer <br />applications and concurrent reviews effective June 30, 2000. The letter also introduced a new category <br />for Hotel & Restaurant License with a Resort Complex. <br /> <br />Bolte also provided a copy of the Boulder County sponsored Server Training notice for the Authority's <br />information, which she stated was mailed to all Louisville liquor license holders. <br /> <br />6 <br /> <br /> <br />
