Louisville Local Licensing Authority
Meeting Date: July 31, 2000 "
Page 7

in favor of the application. None heard.

Chairperson Myers asked if there-~cas any interested p ~ayt_.y in the audience who wished to speak
in opposition of the application. None heard.

Member Jeffers asked Attorney Kelly if the applicant had adequately answered the items listed
in her memorandum dated June 2, 2000. Attorney Kelly responded that the items had been
adequately answered with the exception of the lease term, which has not yet been revised by the
landlord to reflect a commencement date. She continued that the applicant has been requested to
provide the Authority with copies of the additional documentation executed between the two
parties after their opening, to which the applicant has agreed.

Member Jeffers stated he had qtiestions regarding the diagram of the premises, specifically the
outdoor patio area. He asked Mr. Weigand to clarify the height of the fencing and retaining wall
and the location and monitoring of any access gates or doors to the patio area.

Mr. Weigand stated that the retaining wall tapers from approximately 6' along the walkway,
down to a 3' area around the outdoor seating. He stated the retaining wall is of flagstone
construction and will have wrought iron fencing on top. Mr. Weigand stated that there is an
ingress/egress gate near the main entrance of the restaurant that is required by the Louisville
Buildin~g code. He explained that patrons would enter the restaurant through the main doors,
place their meal order, then be seated and served their meal at their table.

Member Jeffers asked about a door located at the edge of the patio area. Mr. Weigand stated that
the door is for patrons exiting the restaurant, though patrons on the patio can exit through the
wrought iron gate. Mr. Weigand stated that patrons pay for their meal at the time they place
their order and that any beverages ordered and paid for are given to the patrons at the service
counter.

Chairperson Myers asked if the back end of the patio was enclosed and how the patio area would
be monitored to prevent patrons from leaving the premises with an alcoholic beverage. Mr.
Weigand responded that servers or busers would likely be present on the patio whenever patrons
were present and that the beer and wine is stored in coolers located behind the service area,
inaccessible to patrons.

Chairperson Myers asked if the service counter would be staffed with a person of the appropriate
age for the sale of alcohol and if that person would be would be supervised. Mr. Weigand
responded that it was his understanding that persons had to be 18 years of age to serve alcohol.
Mr. Macchiaroli added that between one and three managers will be on duty during business
hours and that staff under the age of 18 is not allowed to touch the al_coholic beverages, and must
seek a manager for assistance.

Chairperson Myers asked the applicant if they wished to make any closing comments. Mr.
Weigand stated they had completed their presentation.

7
