Planning Commission <br />Meeting Minutes <br />July 10, 2014 <br />Page 11 of 14 <br />Staff states that the school location is within 1100 feet from the marijuana dispensary. The <br />Code is'/4 mile distance, 1320 feet. The Code is written in that it regulates the stores, saying <br />"no retail store at the time it is established for first license may be located within that buffer." <br />The Code does not regulate the school, but prevents another dispensary from locating there. <br />Staff is fine with removing the proposed parking condition given the new information about the <br />parking agreement. Staff will speak with the City Attorney regarding the issue with marijuana <br />dispensary. <br />The applicant wants clarification that the City Code regulates the marijuana stores from coming <br />in, not the prevention of a preschool. <br />Pritchard will ask the City Attorney to clarify without any doubt regarding the interpretation of the <br />Code. <br />Closed Public Hearing and discussion by Commission: <br />Moline is in support once marijuana issue is resolved. <br />Brauneis is in support. <br />Tengler is in support. <br />O'Connell is in support. <br />Rice is in support. <br />Pritchard is in support. <br />Motion to approve Resolution No. 11, Series 2014 by Brauneis striking recommended condition <br />from Staff, Tengler seconded. The condition would state that it is subject to the City Attorney's <br />opinion to the applicability of the ordinance limiting proximity of Goddard School to a marijuana <br />facility. The 2013 study done during four days in <br />July broader than the 2010 study, covering greater area of Old Town and Downtown. Early in <br />2014, Staff began analyzing and looking for solutions. City Council appointed a Parking Action <br />Committee who held public meetings in March and April. Planning Commission and City Council <br />have seen the results. Staff is now bringing forth recommendations for Planning Commission <br />approval and then on to City Council. Once approved, the Action Plan will be put into place. <br />The results of the exercise generated the following project goal statement formally adopted by <br />the Parking Action Committee June 10, 2014. <br />
