Properties notified and mailings sent out on <br />October 201", 2017. <br />No disclosures form Commission. <br />Ritchie entered an ordinance into the record with legal descriptions for the properties and the <br />ordinance to be presented to City Council. <br />Sheets moved and Rice seconded a motion to submit the ordinance into the record. Motion <br />passed unanimously by voice vote. <br />Ritchie presented the Louisville City Charter Section 15-3(b), which requires that the City <br />provide an Open Space Zoning District. It states: <br />The City's ordinances shall provide for an open space zone district into which <br />shall be placed all land which is located wholly within the City and which has <br />been designated as open space... <br />In 2011, City established the Open Space Zone District. Ritchie then presented the 12 <br />properties in question. Aquarius, Avista, Bullhead Gulch, Centennial Trail Corridor, Coal Creek <br />Trail Corridor, Coyote Run, CTC, and Gateway Open Spaces. Harper Lake Open Space covers <br />Harper Lake and staff confirmed with Public Works and the City water attorney that rezoning <br />would not interfere with utility operations. Also, Hecla and North Open Spaces. Finally, <br />Warembourg Open Space is zoned as "planned commercial development open space," but it is <br />still not compliant with City Charter requirements. <br />All properties were evaluated by Open Space Advisory Board in July and the Board confirmed <br />that the properties are designated as open space and recommended approval for the zone <br />change. <br />Ritchie then presented the Zone Change Criteria: <br />1. The land to be rezoned was zoned in error and as presently zoned is <br />inconsistent with the policies and goals of the city's comprehensive plan. Staff <br />finds the first part of this criterion not applicable. Staff finds the proposal <br />meets the second part of this criterion. <br />2. The area for which rezoning is requested has changed or is changing to such <br />a degree that it is in the public interest to encourage redevelopment of the <br />area. Staff finds this criterion is met. <br />3. The proposed rezoning is necessary to provide land for a community -related <br />use which was not anticipated at the time of the adoption of the city's <br />comprehensive plan, and such rezoning will be consistent with the policies <br />and goals of the comprehensive plan. Staff finds this criterion is met. <br />4. The rezoning would only permit development which, if evaluated as a <br />proposed annexation under standards and procedures codified in Title 16, <br />would qualify for annexation. Staff finds this criterion is met. <br />
