Planning Commission <br />Meeting Minutes <br />November 9, 2017 <br />Page 3of7 <br />Staff recommends approval of Resolution 23, Series 2017 for a request to rezone certain City - <br />owned property to Open Space Zone District. Ritchie added that no change in management <br />would occur based on this rezoning as these properties already appear and function as open <br />space. The goal of the rezoning is to align with the City Charter requirements. <br />Moline asked if the City Code included use restrictions for open space. <br />Ritchie responded that uses for open space in the code simply refer to City Charter. There are <br />no use restrictions in the code aside from referring to the charter. <br />Rice asked what the effect of rezoning would be aside from housekeeping. <br />Ritchie responded that staff opinion was that it was a housekeeping matter. <br />Zuccaro added that Title 4 of the City Ordinance has a list of prohibited and allowed uses and <br />offered to answer specific questions about use from the Commission. <br />Rice clarified that properties previously zoned as commercial would no longer be available for <br />commercial use. <br />Ritchie confirmed that rezoning from commercial to open space would have that effect. <br />Rice asked if there are open space properties that have not yet been considered for rezoning. <br />Ritchie confirmed that there were remaining properties. There are two possibilities for why staff <br />is not bringing them forth at this time. First, they may need survey work to develop a legal <br />description that matches the area proposed for rezoning. Second, further study and direction <br />may be need from the Parks and Public Landscaping Board and the Open Space Advisory <br />Board to determine the designated areas. <br />Hsu asked for clarification on criterion three, stating that the there was a potential discrepancy <br />between the criterion and staff recommendation. He asked how something that was not <br />anticipated in the Comprehensive Plan, as required in criterion three, also be contemplated, as <br />suggested by staff recommendation. <br />Zuccaro responded that staff applied the requirement to consider zoning at the time of the <br />adoption of the plan to the current plan, which shows the properties as open space. He added <br />that staff interpreted the criterion to mean was the property contemplated to be open space at <br />that time. Staff used the current plan and judged if the property was open space based on the <br />most recent plan. <br />Ritchie stated that the Commission could find criterion three not applicable. <br />Ember Brignull, Open Space Manager for the City of Louisville, 595 Gillaspie Drive, Boulder CO <br />was available for questions from the Commission. The Commission had no additional questions <br />Pritchard asked for comments from the public. <br />Barbara Holub 848 Trail Ridge Drive, Louisville, CO asked if current management <br />responsibilities in PUDs for the properties would change after rezoning. <br />Zuccaro stated that this rezoning would not affect management and there would be no transfer <br />of responsibility. <br />
