Planning Commission <br />Meeting Minutes <br />July 12, 2018 <br />Page 5 of 6 <br />Ritchie stated that so far staff had been able to accommodate the timeline of the applications. <br />Rice asked why the federal regulations shortened the review deadlines. <br />Ritchie stated that the industry had been involved in the legislative process, as had residents <br />who wanted more data. <br />Moline asked how the proposed changes would materially change the code. <br />Ritchie replied that small -cell facilities would be allowed in the City. The design standards are <br />improved but not dramatically different. <br />Moline asked if the small cells would come before the Commission. <br />Ritchie stated that they would be approved through a license agreement with the City Manager's <br />office. <br />Hsu asked what applicants could do if staff denied their applications. <br />Ritchie stated that it would depend on why staff denied the application. If the applicant met the <br />criteria, the City had to approve it due to federal law. If denied, the applicant could appeal the <br />director's decision or staff could send it to a public hearing. <br />Zuccaro stated if there is a disagreement over the interpretation of the zoning code, the <br />applicant could also go to the Board of Appeals to appeal staff's interpretation of the zoning <br />code. It could also go to District Court. <br />Hoefner made a motion to approve Resolution 12, Series 2018 regarding the amendment of the <br />Louisville Municipal Code regarding wireless facilities. Rice seconded. Roll call vote. Approved <br />unanimously. <br />COMMISSIONER COMMENTS <br />Hsu asked for general comments from the Commission. He noted that Chair Brauneis was <br />interested in discussing takeaways from the City Council study session. He suggested putting <br />that on the agenda for the next meeting. <br />Rice commented that he felt bad that the applicant for Item 2 on tonight's agenda and members <br />of the public had come out in full force. He stated that the Commission had expected to have <br />quorum tonight, but abstentions could not be avoided when they were necessary. In his tenure <br />on the Commission this was the first time they had not been able to hear an item due to lack of <br />quorum. He was sorry to the applicants and members of the public. <br />Howe asked if members of the public could comment on items on the agenda as though they <br />were off the agenda in the absence of a quorum. <br />Hsu replied no and Rice added that the Commission could not consider those comments in their <br />decision, anyway. <br />Zuccaro added that there would be no additional notice given for the future meeting. <br />Howe commented on building requirements, stating that looking into the benefits of alternate <br />energy could inform objective measures for new buildings that are created. <br />
