Louisville Local Licensing Authority <br />Meeting Date: October 30, 2000 <br />Page 3 <br /> <br />until the Local Licensing Authority received a copy of the certificate. <br /> <br />Member Jeffers moved to approve the Consent Agenda. <br /> <br />Authority Attorney Kelly noted she had a few more corrections. She stated that question (9b) of the <br />renewal application for Consent Agenda item (M) had not been answered by the licensee. Additionally, <br />question (9c) of the renewal application for Consent Agenda item (D) had been left blank. <br /> <br />Member Jeffers moved that the Consent Agenda be approved contingent upon correction by the <br />applicants of the noted deficiencies. Member Kimmett seconded the motion. All members were in <br />favor, the motion carried. <br /> <br />AUTHORITY BUSINESS <br /> <br />mo <br /> <br />Show Cause Hearing - Hei Han Enterprises, Inc., d/b/a Henry's Bar & Grill - Tavern <br />Liquor License - 935 Pine Street. <br /> <br />Chairperson Myers opened the hearing for Hei Han Enterprises, Inc., d/b/a Henry's Bar & Grill and <br />introduced Special Prosecutor Steve Barnett. <br /> <br />Attorney Barnett greeted the Authority and stated that he had met with the licensee and discussed the <br />alleged violation on July 27, 2000 involving the sale and service of alcohol to a visibly intoxicated <br />person. Barnett stated that the proposed Stipulation and Agreement contained in the Authority's packets <br />was the result of that meeting and is now before the Authority for their review and determination. <br /> <br />Special Prosecutor Barnett outlined the contents of the Stipulation and Agreement which included, <br />admission of guilt by the licensee to violations of C.R.S. § 12-47-901 (1)(a), C.R.S. § 12-47-901 (5)(a)(I), <br />Louisville Municipal Code §9.22.060 and Alcohol Beverage Regulation §47-900. The Agreement <br />called for suspension of the licensee's current liquor license for a period of twenty-one (21) days with <br />seven (7) days held in abeyance for a period of one year, pending no further violations of the Colorado <br />Liquor Code or Regulations. Attorney Barnett noted for the Authority that this is the maximum penalty <br />for a second offense as outlined in the Authority Rules of Procedure. Additionally, the licensee would <br />serve the two (2) days held in abeyance from the July 15, 2000 Stipulation and Agreement on a previous <br />violation. <br /> <br />Attorney Barnett closed by stating that the licensee has agreed to suspend the sale and service of alcohol <br />for sixteen (16) days beginning Saturday, November 18, 2000 through Sunday, December 3, 2000. <br /> <br />Member Jeffers asked if the licensee stated any particular reason for choosing the dates of suspension. <br />Barnett stated he was not aware of any particular reason for the suspension dates. <br /> <br />Member Jeffers moved to approve the proposed Stipulation and Agreement. Chairperson Myers <br />seconded the motion. Roll Call Vote: Kimmett - yes, Myers - yes, Lipton - yes, Evans - yes, Jeffers - <br />yes. All members were in favor, the motion carried. <br /> <br /> <br />
