Louisville Local Licensing Authority <br />Meeting Date: October 30, 2000 <br />Page 4 <br /> <br />Public Heating - Renewal Application - Zuned Ahmed Khan d/b/a Taj Mahal III - Hotel <br />& Restaurant Liquor License - 1075 S. Boulder Road. <br /> <br />Chairperson Myers called to order the Show Cause Heating for the hotel and restaurant renewal <br />application of Zuned Ahmed Khan d/b/a Taj Mahal III. <br /> <br />Chairperson Myers stated "for the record, I am Bryan Myers, Chair of the City of Louisville Local <br />Licensing Authority. This is the hearing on the application for renewal of a hotel and restaurant liquor <br />license held by Zuned Ahmed Khan dPo/a Taj Mahal III." <br /> <br />Myers continued that "the purpose of this heating is to receive evidence to enable the Authority to make <br />findings and reach a conclusion as to whether the license should be renewed. Specifically, the Authority <br />will be examining evidence to determine whether there has been a change in financial interest in the <br />license, and whether Jamal Quereshi is still the manager at this licensed establishment, as is indicated on <br />the application for renewal." <br /> <br />Chairperson Myers stated that the Authority Attorney had a few comments. <br /> <br />Authority Attorney Kathleen Kelly stated that public notice of the hearing was published in accordance <br />with state law and that the applicant was also given notice of the hearing, and the matters to be <br />addressed. Kelly continued however, that the applicant did not post the premises as is also required by <br />state law and that the Authority is therefore without jurisdiction to hear evidence on the application. <br />Attorney Kelly then stated that both parties were present and that in lieu of a hearing, Special Prosecutor <br />Bruce Joss and the applicant, Zuned Khan, have requested to address the Authority with certain matters. <br /> <br />Member Jeffers asked Attorney Kelly if the public hearing should be continued to the next meeting. <br />Kelly stated that the Authority should allow the Special Prosecutor and applicant to present information <br />and then decide how best to proceed with the hearing. <br /> <br />Special Prosecutor Bruce Joss greeted the Authority and began by stating that a Stipulation and <br />Agreement had been offered to the applicant, Zuned Khan, and that Mr. Khan has agreed to the terms of <br />the Stipulation. Attorney Joss summarized that the Agreement would call for suspension of the <br />licensee's current liquor license from the date the Stipulation is signed into order until the next regularly <br />scheduled meeting of the Local Licensing Authority, November 27, 2000. <br /> <br />Special Prosecutor Joss outlined the reasons for the proposed Stipulation. He stated that there had been <br />four separate violations of the state statutes by this establishment. The first violation is under § 12-47- <br />301(3)(a), which states in part that it is unlawful for any person to exercise any of the privileges granted <br />under any license other than that which the person holds or for any licensee to allow any other person to <br />exercise such privileges granted under the licensee's license; the second § 12-47-301(7), which states in <br />part that a licensee shall report each transfer or change of financial interest in the license to the state <br />licensing authority and, to the local licensing authority within thirty days after the transfer or change; <br />and § 12-47-301(8), which states in part that a licensee shall report any change in managers to the state <br />and local licensing authorities within thirty days after the change. <br /> <br />4 <br /> <br /> <br />
