Louisville Local Licensing Authority <br />Meeting Date: November 27, 2000 <br />Page 3 <br /> <br />Authority Attorney Kathleen Kelly noted for members that the attorney for the licensee, Kevin Moore <br />had submitted via fax an Entry of Appearance and Motion to Continue at 5:14 p.m. November 27, 2000. <br />She stated to the Authority that a determination must be made prior to proceeding with the hearing <br />whether or not to grant the request for continuance submitted by Attorney Moore. <br /> <br />Member Kimmett stated that he felt the licensees and their attorney were notified well before the <br />scheduled hearing, and that he was not in favor of granting a continuance. <br /> <br />Member Jeffers moved to deny the request for continuance. Member Evans seconded the motion. Roll <br />Call Vote: Kimmett - yes, Lipton - yes, Turner - yes, Evans - yes, Jeffers - yes. All members were in <br />favor, the motion carried. <br /> <br />Vice Chairperson Lipton called the Show Cause hearing to order and stated the following: <br /> <br />"For the record, I am Marguerite Lipton, Vice Chairperson of the City of Louisville Local Licensing <br />Authority. This is the hearing to show cause why the liquor license held by Holly & Mike's Ribs, Inc., <br />d/b/a Hickory Sticks, should not be suspended or revoked for alleged violations of one or more <br />provisions of the State Statutes, Colorado Liquor Code and Liquor Code Regulations and/or the <br />Louisville Municipal Code." <br /> <br />She continued that "the purpose of this hearing is to receive evidence to enable the Authority to make <br />findings and reach a conclusion as to whether there is sufficient evidence proving the Licensee violated <br />one or more of the laws and regulations specified in the Show Cause Order, and if so, whether <br />revocation or suspension of the Licensee' s license is appropriate." <br /> <br />Vice Chairperson Lipton stated that the order of the hearing would be as follows: <br /> <br />Opening Statements by the City and the Licensee. <br />Presentation of evidence by the City, followed by cross-examination by the Licensee. <br />Presentation of evidence by the Licensee, followed by cross-examination by the City. <br />Rebuttal Evidence by the City and Licensee, if any. <br />Closing statements by the City 'and the Licensee. <br /> <br />Vice Chairperson stated that "this hearing is being recorded. Anyone wishing to address the Authority <br />must speak clearly into the microphone and identify himself or herself by name and address. All <br />testimony will be given under oath. Exhibits will be first marked by the Secretary and then identified <br />before offering them for admission. A record will be kept of all exhibits admitted and rejected." <br /> <br />Vice Chairperson Lipton asked the attorneys for the City and Licensee to please identify themselves and <br />state whether they are ready to proceed. <br /> <br />Attorney Steve Barnett, appointed Special Prosecutor for the Authority, stated his name and address for <br />the record and stated that he was ready to proceed. <br /> <br />3 <br /> <br /> <br />
