Louisville Local Licensing Authority <br />Meeting Date: December 18, 2000 <br />Page 3 <br /> <br />Deputy City Clerk Bolte stated that the application is for a Beer and Wine liquor license and that copies <br />of the entire application have been provided to each Authority member. She stated that the application <br />was not complete. Bolte continued that fingerprint reports are on file with the state and that public <br />notice of the hearing was posted and published in accordance with state law. <br /> <br />Authority Attorney Kelly reminded members that the applicant appeared before the Authority at their <br />last meeting and that the Authority determined that the application was not complete because there was <br />not evidence to support legal possession of the premises. Attorney Kelly noted that a copy of a letter <br />from Venture Investments Ltd., dated December 12, 2000 has been provided to the Authority as part of <br />the hearing materials. She continued that the letter contains approval by the landlord, Columbine West <br />LLC, of the subtenant, Byung U. Min d/b/a Little Tokyo for the premises for which the liquor license is <br />being sought. Attorney Kelly stated that the applicant was unable to obtain a finalized document <br />containing the signatures of all the sublessors and sublessees in time for this hearing and that the <br />Authority will have to determine whether the application is complete in order to proceed with the public <br />hearing. <br /> <br />Members briefly reviewed and discussed the sublease documents and related letters of consent <br />contained in the member packets. <br /> <br />Chairperson Myers moved that the application as provided is complete for purposes of the public <br />hearing. Vice Chairperson Lipton seconded the motion. Roll Call Vote: Jeffers - yes, Myers - yes, <br />Evans - yes, Kimmett - yes, Lipton - yes. All members were in favor, the motion carried. <br /> <br />Chairperson Myers asked if there were any Authority member disclosures. Hearing none, Chairperson <br />Myers asked if anyone present objected to the boundaries of the neighborhood being the current <br />boundaries of the City of Louisville. <br /> <br />Hearing none, Myers moved that the entire application as contained in the Authority packets be made a <br />part of the record of the hearing. Vice Chairperson Lipton seconded the motion. All members were in <br />favor, the motion carried. <br /> <br />Chairperson Myers asked the applicant and witnesses present at the public hearing that would be <br />testifying, to come forward, and take the oath. <br /> <br />Deputy City Clerk Bolte asked Mr. Min and the witnesses to raise their right hands and proceeded with <br />the oath "Do you solemnly swear or affirm under penalty of perjury that the testimony you are about to <br />give will be the truth, the whole truth, and nothing but the truth?" <br /> <br />Mr. Byung U. Min, Mr. Martin Ters, DDS, Mrs. Debra Ters and Mr. Richard Hogue all responded <br />"yes." <br /> <br />Chairperson Myers asked the applicant to make his presentation. <br /> <br />Attorney Gary Gottesfeld, 730 17th Street, #777, Denver, Colorado introduced himself as attorney for <br /> <br /> <br />
