Vice <br />Chairperson Lipton asked who would be the registered manager for the Melting Pot Louisville <br />restaurant. Mr. Barber stated that the question concerning the registered manager had been confusing. <br />He continued that he is a managing partner of LSL, LLC and that Kyle Reed, also a partner of LSL, <br />LLC is the operations manager. Mr. Barber stated that each restaurant also has a manager that is in <br />charge of the daily operations. <br /> <br />Member Jeffers stated that the on-site manager who is in charge of the sales and service of alcoholic <br />beverages, should be the registered manager, and will need to submit an individual history report and <br />submit the necessary fingerprint cards to complete a background check. <br /> <br />Chairperson Myers moved to approve the application for transfer of the hotel and restaurant liquor <br />license from SGG, LLC d/b/a The Melting Pot Louisville to LSL, LLC d/b/a The Melting Pot Louisville <br />contingent on the applicant providing its Federal Employer ID Number, a copy of the personal note <br />between Max Barber and David French, and favorable outcome of the background investigation for the <br />registered manager of the Louisville restaurant. Member Jeffers seconded the motion. Roll Call Vote: <br />Kimmett - yes, Lipton - yes, Evans - yes, Jeffers - yes, Myers - yes. All members were in favor, the <br />motion carried. <br /> <br />mo <br /> <br />Final Decision and Order Draft - Holly & Mike's Ribs, Inc., d/b/a Hickory Sticks - Hotel <br />& Restaurant Liquor License - 1000 S. Boulder Road. <br /> <br />Authority members were given a copy of a newspaper article concerning Holly & Mike's Ribs, Inc., <br />d/b/a Hickory Sticks and a police report filed with the Boulder County Sheriff's Office on December 9, <br />2000 alleging five bad checks between October 5, 2000 and October 19, 2000. <br /> <br />Members discussed the contents of the article and determined that the Final Decision and Order needs to <br />be addressed separate from the issues raised in the article. <br /> <br />Authority Attorney Kelly outlined the contents of the Final Decision and Order. <br /> <br />Chairperson Myers stated that he was somewhat surprised that the Authority chose to hold all three days <br />of the suspension penalty in abeyance. Member Jeffers stated that they were indeed generous, feeling <br />that suspending the liquor license was not going to provide a means for the licensee to pay sales tax in a <br />more timely manner. Chairperson Myers stated that he understood the reasons for the Authority's <br />decision, but wondered if the wrong message was being sent. He continued that the licensee had been <br />told to catch up on their sales tax payments and keep current or else and now, once again, they are being <br />told to catch up and stay current or else. <br /> <br />Member Jeffers moved to approve the Findings of Fact, Conclusions of Law, and Final Decision and <br />Order as written. Member Kimmett seconded the motion. Roll Call Vote: Myers - yes, Jeffers - yes, <br />Lipton - yes, Evans- yes, Kimmett - yes.
