None heard. <br /> <br />Chairperson Myers asked the applicant wished to make any closing comments. Attorney Gottesfeld <br />stated that he hoped the Authority understands the circumstances of the applicant with respect to the <br />lease agreement and that he considers the matter relatively benign. <br /> <br />Chairperson Myers closed the public hearing and called for member discussion and comments. <br /> <br />Member Jeffers moved that the Local Licensing Authority of the City of Louisville find that the <br />applicant is of good moral character, that the inhabitants of the neighborhood desire the license be <br />granted, that the license will meet the reasonable requirements of the neighborhood, that all City and <br />state law requirements have been met and that, based on these findings, the Local Licensing Authority <br />approve issuance of a beer and wine liquor license for Byung U. Min doing business as Little Tokyo <br />contingent on receipt of a finalized, signed and executed copy of the lease agreement by the Authority <br />Secretary. Vice Chairperson Lipton seconded the motion. Roll Call Vote: Evans - yes, Jeffers - yes, <br />Myers - yes, Kimmett - yes, Lipton - yes. All members were in favor, the motion carried. <br /> <br />Transfer Application -- LSL, LLC, d/b/a The Melting Pot Restaurant - Hotel & <br />Restaurant Liquor License - 732 Main Street. <br /> <br />Authority Attorney Kelly advised members that this application was received on December 14th and the <br />applicant, just prior to the hearing, was provided with her letter noting deficiencies on the application <br />for transfer. <br /> <br />Member Jeffers asked if the application for transfer was a housekeeping matter. He stated that he <br />recalled a name change being brought before the Authority in 1999 and questioned if the procedure had <br />been incorrect. <br /> <br />Deputy City Clerk Bolte stated that the discrepancy was uncovered when the applicant submitted its <br />renewal application, that the sales tax number the state had on file did not agree with the City's business <br />license database. Bolte continued that upon contacting the Liquor Enforcement Division it was <br />discovered that a Trade Name Change had been filed with state and local licensing authorities and that a <br />transfer of the liquor license should have occurred instead. <br /> <br />Attorney Kelly noted that both entities SGG LLC, owner of the building, and LSL LLC, owner of the <br />business, are comprised of the same individuals, and that the issue was confusing at the time. She stated <br />that upon review of the events surrounding the previous change, the applicant displayed good faith and <br />has been very cooperative in providing the information necessary to complete the transfer application <br />and tie up the loose ends. <br /> <br />Attorney Kelly stated that the items noted as deficient in her letter are minor with the exception of the <br />Registered Manager. Attorney Kelly stated that state statutes prohibit a person from being a registered <br />manager for more than one hotel and restaurant liquor license. She noted that Kyle Reed is on file with <br />the state as being the registered manager at the Melting Pot in Littleton, which also holds the same class <br /> <br />6 <br /> <br /> <br />
