Louisville Local Licensing Authority <br />Meeting Date: February 26, 2001 <br />10 <br /> <br />,,vas a security officer for Korean Airlines. Shin also stated that his brother is a law abiding citizen and respects <br />law enforcement. <br /> <br />Rennich asked Mr. Shin if Mr. Meagher was a regular customer at Bungaloxv. Shin stated he was. Rennich asked <br />Shin to describe how Mr. Meagher generally behaved when he came into the store. Shin stated that he always <br />talked the same, and walked very animated. Attorney Rennich asked Mr. Shin to demonstrate how Mr. Meagher <br />walked, and Mr. Shin demonstrated this by walking several feet. Rennich asked Mr. Shin what Mr. Meagher <br />usually purchased in the store. Shin stated that Meagher usually purchased a twelve-pack of Budweiser, but that <br />on that night he came in to purchase a gift. Shin stated that he went to the back of the store and picked out the <br />Jack Daniel's gift set for Mr. Meagher and brought it up to the counter. <br /> <br />Attorney Rennich asked Mr. Shin if he had asked Mr. Meagher if he had been drinking that evening. Mr. Shin <br />stated that he did not ask because Mr. Meagher was a regular and was acdng like he always did. <br /> <br />Attorney Rennich asked Mr. Shin how far it is from the front door of the liquor store to the service counter. Mr. <br />Shin stated that it was about four or five feet. Rennich asked Shin if he smelled alcohol on Mr. Meagher's <br />breath. Shin stated he did not, and that he would not have sold to Mr. Meagher if he had appeared intoxicated. <br />Rennich asked Shin if Mr. Meagher fumbled ~vith his credit card or wallet. Shin stated he did not. Rennich <br />asked Mr. Shin if he had timed a recreation of the transaction with Mr. Meagher. Shin stated he had, and that it <br />had taken one minute and forty-five seconds. <br /> <br />Attorney Rennich asked Mr. Shin what he thought Mr. Meagher did for a living. Mr. Shin stated that he thought <br />Mr. Meagher ~vas an attorney because he talked about working in D.C. and making lots of money. Rennich <br />asked Mr. Shin his opinion about lawyers. Shin stated that he and his brother respect lawyers. <br /> <br />Chairperson Myers asked members if they had any questions for the witness. Vice Chairperson Lipton asked <br />Mr. Shin why he stated that he never asks customers if they have been drinking. Mr. Shin stated that he would <br />ask if a regular customer is acting different than normal, and has done so in the past. Member Koertie asked Mr. <br />Shin how he determines if someone is visibly intoxicated. Shin stated that he can't tell just by looking at them <br />that only after seeing a regular customer acting different will he start talking to them to about whether they have <br />been drinking. <br /> <br />Attorney Rennich called his second witness, Mr. Chan Soo Lee. Deputy City Clerk Bolte administered the oath. <br />Mr. Shin acted as translator for Mr. Lee. <br /> <br />Attorney Rennich asked Mr. Lee what the store policy is regarding sale of alcohol to intoxicated persons. Mr. <br />Lee stated that the policy is not to sell to visibly intoxicated persons or persons under the age of 21. Rennich <br />asked Lee how Mr. Meagher behaves in the store. Lee stated that Meagher always talks in a loud voice and <br />swings his arms ~vhen he walks. Rennich asked Lee what he thought Mr. Meagher did for a living. Lee stated he <br />thought Meagher was an attorney. Rennich asked Lee where he was when Mr. Meagher purchased the Jack <br />Daniel's gift set on December 1, 2000. Lee stated he had walked to the Safeway to get something to eat. <br /> <br />Attorney Rennich called his last witness, Sergeant Jerry Riggins. Deputy City Clerk Bolte administered the oath. <br />Rennich asked Sergeant Riggins if he has ever had contact with Mr. Shin or Mr. Lee and what their level of <br />cooperation is with the Louisville Police Department. Riggins stated that he has had a great deal of contact with <br />Bungalow Wine 8,: Spirits as with all the licensed establishments in Louisville. Riggins stated that their level of <br />cooperation is what he xvould expect, exemplary.
