Louisville Local Licensing Authority <br />Meeting Date: February 26, 2001 <br />9 <br /> <br />Attorney Rennich asked Mr. Meagher if he purchased Budweiser the evening of December 1, 2000. Meagher <br />stated he did not. Meagher stated that he had gone to Bungalow to purchase a gift, that he had told Mr. Shin he <br />~vas there to purchase a gift, and that Mr. Shin went and picked out a gift for him. Rennich asked Meagher how <br />he paid for the purchase. Meagher stated he paid with a credit card. <br /> <br />Attorney Rennich asked Mr. Meagher if he knocked over any displays in the store, fell down in the store, lost his <br />credit card or wallet in the store. Meagher stated that none of those things happened. <br /> <br />Chairperson Myers asked if members had any questions for the ~vitness. Vice Chairperson Lipton asked Mr. <br />Meagher ~vhy he was surprised Mr. Shin was issued a ticket. Meagher stated he was not surprised. Lipton asked <br />Meagher why he would not have sold liquor to someone in his condition that evening. Meagher stated that he <br />did not know how he appeared and based his statement on how he perceived himself. Lipton asked Mr. <br />Meagher ~vhat happened to him at the treatment center. Meagher stated that he just sat there for several hours <br />and then they released him. Lipton asked Mr. Meagher again why he would not have sold alcohol to someone in <br />his condition that night. Meagher stated that his opinion was based on the fact that a police officer determined <br />him to be intoxicated, therefore he must have appeared so. Lipton asked Mr. Meagher if he normally talked with <br />slurred speech. Meagher stated he did not have any speech problems. <br /> <br />Member Kimmett asked Mr. Meagher ~vhy he parked in the fire lane. Meagher stated he did not park the car. <br />Kimmett asked who parked the car. Meagher stated that the guy that drove him from the bar parked the car. <br />Meagher continued that the guy lived in Christopher Village and that he told the guy to wait for him in the car <br />but that he must have left. <br /> <br />Special Prosecutor Shapiro called his final witness, Minchul Shin. Deputy City Clerk Bolte administered the <br />oath. Attorney Shapiro asked Mr. Shin if he was subpoenaed to appear at this hearing and whether or not he <br />brought with him the videotapes from the liquor store cameras for the evening of the incident December 1, <br />2000. Mr. Shin stated that he was issued a subpoena to appear and that he did not bring the videotape that was <br />requested. Attorney Shapiro asked Mr. Shin why he did produce the videotape. Mr. Shin stated that the tape <br />had run out much earlier in the evening and the tape had not been replaced. Shapiro asked Mr. Shin if it was a <br />normal practice not to replace the tapes. Mr. Shin stated that the tapes they use vary in length and run out at <br />different times. Shin continued that they had the same problem with the previous violation when they had also <br />been requested to provide the tape but it had run out. <br /> <br />Attorney Shapiro asked Mr. Shin his profession. Shin stated that he is the manager for Bungalow Wine & <br />Spirits. Shapiro asked if he was on duty, December 1, 2000, when the incident described by Officer Sundberg <br />and Mr. Pearse Meagher occurred. Shin stated that he was the person that assisted Mr. Meagher that evening. <br />Shapiro asked Mr. Shin if he sold Mr. Meagher the Jack Daniel's gift set pictured in Exhibit "B". Shin stated he <br />did. <br /> <br />Attorney Rennich stated that Mr. Shin is to be one of his defense witnesses and asked the Authority that he be <br />allowed to extend his questioning beyond the bounds of normal cross-examination. Chairperson Myers <br />approved the request. <br /> <br />Attorney Rennich asked Mr. Shin what the policy is at Bungalow Wine & Spirits concerning the sale of alcohol <br />to an intoxicated person. Mr. Shin stated that the policy his brother, Mr. Chan Soo Lee, established is never sell <br />to an intoxicated person or underage person and that he, Mr. Shin, attends all the City liquor training sessions. <br /> <br />Attorney Rennich asked Mr. Shin what his brother's profession was in Korea.
