Sundberg <br />stated it is possible, but that it is not possible for a person to change the appearance of their eyes. Attorney <br />Rennich asked Sundberg if he was inside Bungalow Wine & Spirits when Mr. Meagher made his purchase. <br />Sundberg stated he was not. Rennich asked Sundberg if he had witnessed Mr. Meagher's behavior while in the <br />store, or had heard any of the conversation between Mr. Meagher and Mr. Shin. Sundberg stated he had not. <br />Rennich asked Sundberg if he had witnessed Mr. Meagher walking around inside the store. Sundberg stated he <br />had not. <br /> <br />Attorney Rennich asked Officer Sundberg about the type of liquor that was purchased by Mr. Meagher and <br />whether or not the gift set had been opened or tampered with. Sundberg stated that it ',vas a gift set containing a <br />bottle of Jack Daniel's and two glasses. Attorney Rennich asked Officer Sundberg why he allowed Mr. Meagher <br />to keep the alcohol he purchased when the Officer believed him to be visibly intoxicated. Sundberg stated that <br />the alcohol purchased was placed into Mr. Meagher's vehicle because he did not want to mess with people's <br />finances. <br /> <br />Prosecuting Attorney Shapiro called his second witness, Mr. Pearse Meagher. Deputy City Clerk Bolte <br />administered the oath. Mr. Meagher stated his name and address, 1830 Centennial Drive #307, Louisville, CO <br />80027. <br /> <br />Attorney Shapiro asked Mr. Meagher if he had been subpoenaed to appear and whether or not he was the same <br />Mr. Pearse Meagher invotved in the incident described by Officer Sundberg. Mr. Meagher stated that he was <br />subpoenaed to appear he and is the person who was at Bungalow Wine & Spirits on December 1, 2000. <br /> <br />Shapiro asked Mr. Meagher if he was intoxicated at the time he entered Bungalow Wine & Spirits to purchase the <br />Jack Daniel's gift set. Mr. Meagher replied he was. Shapiro asked Mr. Meagher if he would have sold alcohol to <br />a person in his condition that evening, if he had worked at the liquor store. <br /> <br />Attorney Rennich objected to the question. <br /> <br />Chairperson Myers overruled the objection. <br /> <br />Mr. Meagher ',vas directed to answer the question. He stated that he would not have sold alcohol to a person in <br />his condition. <br /> <br />On cross-examination, Attorney Rennich asked Mr. Meagher if Mr. Shin was the person who waited on him that <br />evening. Mr. Meagher stated he was. Rennich asked Meagher if he had reason to believe that Mr. Shin should <br />have known that he `*vas intoxicated. Mr. Meagher stated he did not know what Minchul thought and that he did <br />not fall down in the store or anything like that. Mr. Meagher stated that everyone has a different opinion about <br />hoxv he appeared. <br /> <br />Rennich asked Mr. Meagher if he was surprised that Bungalow Wine & Spirits was issued a summons. Meager <br />stated he ~vas not surprised. Rennich asked Meagher if Mr. Shin asked him if he had been drinking. Meager <br />stated he did not recall Minchul asking him that. Rennich asked Meagher if he was a regular customer at <br />Bungalow Wine & Spirits and what type of alcohol he normally purchased.
