Louisville Local Licensing Authority
Meeting Date: June 25, 2001

twenty-eight people in the bar that evening. Hayden continued, stating that Lisa also disagreed with
the number of people present as stated in the police report.

Member Kirnmett stated that even one bartender for twenty-eight people ~vould seem difficult to
control. Mr. Hayden stated that Lisa was good and fast and that she stated to him that she had
everything under control. He stated that perhaps Lisa thought that if she called him for help, she
would lose some of her tip money. Mr. Hayden stated that all his staff has been informed to call
him if they get a big crowd in and need help.

Authority Attorney Harrington stated that the Authority needed to consider the settlement
presented by Attorney Joss, and either accept or reject the proposal.

Member Koertje stated that he was in favor of accepting the disposition presented by Attorney Joss
and that he trusted his judgment to dismiss the charges of selling/serving a visibly intoxicated
person. Member Koertje stated that he was bothered by Mr. Hayden's statement that he was not
aware of the meal provisions required by the liquor code.

Member Kirnmett stated that he was also bothered by the lack of meal service, but was more
concerned over the staffing issue. He stated it was and is the responsibility of Mr. Hayden to set
guidelines for his staff on the number of customers that can be monitored by one bartender.

Member Koertje stated his agreement xvith Member I~o_mett's concerns and stated that the licensee
is the one that bears the liability by under staffing his establishment and putting himself at risk for
further incidents.

Member Koertje moved that the Authority Attorney be directed to prepare a Stipulation and
Agreement and Order which incorporate the terms agreed upon by the City and Licensee, for
consideration at the next regular meeting of the Authority, and that this matter be continued until
such meeting. Chairperson Lipton seconded the motion. Roll Call Vote: K_immett - yes, Koertje -
yes, Lipton - yes. All members were in favor, motion carried.

Chairperson Lipton moved to bring the issue of election of a Vice Chairperson back to the table.
Lipton stated that she would not be present for the July 30, 2001 Authority meeting. Attorney
Harrington stated that a Vice Chairperson would need to be elected this evening in order to have a
Chair for the next regular meeting. Harrington stated that the issue could be revisited at a later
meeting should the person elected not wish to continue to serve as Vice Chairperson.

Member I~wn-nett stated he did not wish to serve as Vice Chairperson. Member Koertje stated that
he has not been a member of the Authority for long and might not be the best candidate, but that
based on the situation would be willing to serve as Vice Chairperson. Member Kimmett moved to
elect Member Michael Koertje as Authority Vice Chairperson. Chairperson Lipton seconded the
motion. All members were in favor, motion carried.

VII.
