Louisville Local Licensing Authority <br />Meeting Date: July 30, 2001 <br /> <br />Renewal Application - Holly & Mike's Ribs, Inc., d/b/a Hickory Sticks - Hotel & <br />Restaurant Liquor License - 1000 S. Boulder Road. <br /> <br />Vice Chairperson Koertje asked Detective Lanphere to come forward and explain to the Authority <br />the criminal investigation he is conducting regarding Hickory Sticks. <br /> <br />Detective Lanphere stated to the Authority that he had handed out a memo prior to these <br />proceedings requesting the Authority table the renewal application for Hickory Sticks. Lanphere <br />stated that over the past few months he has been investigating the business practices of Michael <br />Davis and Holly Ortiz concerning the writing of bad checks. <br /> <br />Detective Lanphere stated his belief that both Michael Davis and Holly Ortiz knowingly, willingly <br />and consistently continue to write bad checks. Lanphere stated that the five bad checks he is <br />investigating have not been made good as of these proceedings. <br /> <br />Member Sackett asked the timeframe of the bad checks being investigated. Lanphere stated from <br />January 2001 through March of 2001. Sackett asked if there had been any bad checks written from <br />March to the present. Detective Lanphere stated that payments that were to have been paid to the <br />previous owners through July have not been made. He continued that he talked with Mike Davis <br />and Holly Ortiz last week, and that they stated they were going through the civil courts to remedy <br />this issue. <br /> <br />Member Sackett asked for clarification. Detective Lanphere stated that Mike and Holly told him <br />that they had paid the former owners and that the checks had cleared the bank. Lanphere stated he <br />asked them for proof these payments had cleared the bank, but has not received such proof to date. <br /> <br />Sergeant Riggins stated that he advised the Authority in the past that there appeared to be an <br />ongoing pattern of criminal activity with the owners of Hickory Sticks. Riggins stated that Detective <br />Lanphere has a considerable amount of data on this case, and that he felt it was important to inform <br />the Authority of this pending criminal case so they may determine whether or not the licensee is of <br />good moral character prior to renewing the liquor license. <br /> <br />Member KJmmett asked Lanphere if the bad checks written to the Department of Revenue for sales <br />tax were part of his investigation. Detective Lanphere stated they were not part of his investigation. <br /> <br />Vice Chairperson Koertje asked Lanphere if he anticipated his investigation being completed within <br />the next month. Lanphere stated he did. <br /> <br />Vice Chairperson Koertje asked when the licensees stated the last payment for the business was due <br />to be paid. Members and staff stated they recalled the last payment was stated by Mr. Davis to be <br />due in June. <br /> <br />Vice Chairperson Koertje stated his opinion that there are enough issues of concern that he would <br />be in favor of the Authority ordering a hearing on this renewal application.
