Louisville Local Licensing Authority <br />Meeting Date: September 17, 2001 <br /> <br />Member Sackett moved to approve the consent agenda. Chairperson Lipton seconded the motion. <br />All members were in favor, motion carried. <br /> <br />AUTHORITY BUSINESS <br /> <br />Corporate Report of Changes - American Legion Post No. 0111, d/b/a American <br />Legion Walter Rhodes Post No. 111 - Club Liquor License - 1130 Pine Street. <br /> <br />Authority Attorney Harrington stated that at the August 27, 2001 meeting, the American Legion <br />expressed the difficulty they encounter each year replacing the three officers named on the liquor <br />license. Harrington stated she had reviewed state statutes and found section [ 12-47-307(I)00)(II), <br />added in 1997, and stating in part that the local body can investigate the character and reputation of <br />the president and club manager for issuance of a new Club liquor license held by a corporation. <br />Attorney Harrington stated that the Authority could reasonably refer to this statute for the purpose <br />of renewal or corporate changes of the Club liquor license for the American Legion. Harrington <br />stated that Deputy City Clerk Bolte had discussed this remedy with Bob Ross, registered agent for <br />thc American Legion, and that Mr. Ross stated that complying with the revised standard would be of <br />benefit to their organization. <br /> <br />Attorney Harrington stated that the club manager would not necessarily change each year, but she <br />understands that the Commander of the American Legion, would serve as the "president" of the <br />corporation, and could change each year. Attorney Harrington stated that the current Commander, <br />Mr. Leroy Lorenzi appeared before the Authority at the August 27m meeting and answered <br />Authority questions concerning the results of his background investigation. Attorney Harrington <br />stated that Bob Ross is present at the hearing and has indicated that he performs all the functions of <br />Club Manager. Mr. Ross has submitted an individual history record for investigation purposes, the <br />results of which have not yet been received. <br /> <br />Harrington stated she would recommend the Authority use the language of statute [ 12-47- <br />307(1)(b)(II) as a basis for accepting the corporate report of changes. <br /> <br />Chairperson Lipton asked Mr. Ross if his driver's license was issued in Colorado. Mr. Ross stated it <br />was. Lipton asked that the revision be noted on the individual history record for Mr. Ross. <br /> <br />Member Jeffers stated that the use of this statute will help streamline the process and stated that the <br />same criteria should be used for any other Club liquor licenses. Jeffers also stated that the <br />explanations given by Mr. Lorenzi at the last meeting satisfied his concerns. <br /> <br />Sergeant Riggins stated that he has known Mr. Ross for many years and knows of no arrests that <br />would affect the outcome of the background investigation. <br /> <br />Chairperson Lipton asked Attorney Harrington if a motion was required to approve the Corporate <br />Report of Changes. Harrington stated that the item was for informational purposes only and that <br />no action was required. <br /> <br />Deputy City Clerk Bolte stated that the item would only come back before the Authority if there <br />were negative findings for Mr. Ross.
