Planning Commission <br />Meeting Minutes <br />July 16, 2020 <br />Page 4 of 12 <br /> <br />Ritchie says that is correct. <br /> <br />Rice asks that under the revitalization step plan, if somebody wants to change the use <br />of that area, are they required to rezone? <br /> <br />Ritchie says that is correct. <br /> <br />Rice asks that if that requirement were not in place, would this use fit into the current <br />zoning. <br /> <br />Ritchie says that is correct. <br /> <br />Rice mentions that looking at the four criteria, the commissioners only need to have one <br />criteria fit and staff has eliminated the third and fourth criteria. He says his problem with <br />the first criteria is word “and.” It is stated in the conjunctive. It says, “The land to be <br />rezoned was zoned in error and as presently zoned is inconsistent with the policies and <br />goals of the city’s comprehensive plan.” He is having a hard time understanding how <br />criteria one applies. <br /> <br />Zuccaro confirms that it does say “and.” <br /> <br />Rice mentions that criteria two does apply though. <br /> <br />Ritchie mentions that the commissioners could lean on criteria two for their approval. <br /> <br />Applicant Presentation: <br />Mike Swisher, general contractor and property manager for the building owner <br /> <br />Swisher says he has no presentation to present to the commissioners and has no <br />further comment. <br /> <br />Commissioner Questions of Applicant: <br />None is heard. <br /> <br />Public Comment: <br />None is heard. <br /> <br />Closing Statement by Staff: <br />Ritchie reminds the commissioners that staff is recommending approval for this <br />proposal. <br /> <br />Closing Statement by Applicant: <br />None is heard. <br /> <br />Discussion by Commissioners: <br />Howe mentions that he knows that there will be six retail marijuana shops in the city but <br />he is concerned about their proximity to schools. He asks the commissioners how they <br />feel about this location and its proximity to the schools. <br />
