City Council <br />Meeting Minutes <br />November 2, 2020 <br />Page 5 of 6 <br />City Clerk Muth read Section 2.90.050of the Louisville Municipal Code, which outlines the <br />topics permitted for discussion in an executive session. <br />City Attorney Kelly stated that regarding the authority for the executive session, Section 5- <br />2(c) of the Home Rule Charter authorizes an executive session for the purpose of <br />consideration of real property acquisitions and dispositions by the City, but only as to <br />appraisals and other value estimates and strategy for the acquisition or disposition of <br />such property. An executive session for this purpose is also authorized by the Open <br />Meetings Law, Section 24-6-402(4)(a) of the Colorado Revised Statutes. <br />Further, Section 5-2(b) of the Home Rule Charter authorizes an executive session for the <br />purpose of reviewing the performance of employees directly appointed by the City <br />Council. An executive session for this purpose is also authorized by the Open Meetings <br />Law, Section 24-6-402(4)(f) of the Colorado Revised Statutes. The request involves <br />further discussion of the performance review of the City Manager as it relates to <br />compensation and evaluations for the City Attorney and Water Attorney. The City <br />Manager, City Attorney, and Water Attorney are all employees directly appointed by the <br />City Council. <br />Mayor Stolzmann moved to go into executive session for the purpose of consideration of <br />real property acquisitions and dispositions and performance review of employees directly <br />appointed by the City Council, and that the executive session include City Manager <br />Heather Balser, Parks, Recreation, and Open Space Director Nathan Mosely, and Deputy <br />City Manager Megan Davis for the portion regarding real property acquisitions and <br />dispositions; and City Attorney Kathleen Kelly, except for the portion regarding the <br />performance review of the City Attorney. <br />Mayor Pro Tern Maloney seconded the motion. <br />Roll Call Vote: Motion passed by unanimous roll call vote. <br />Council went into executive session at 6:30 pm; Council returned from executive session <br />at 9:07 pm. <br />IN4101:4M1]6*91k"11ICZII1]1Vx011@]kiI/_T910Eelki= �1_10a:0]a4:4Wd <br />ACQUISITIONS/DISPOSITIONS; CITY MANAGER COMPENSATION; AND ANNUAL <br />EVALUATIONS OF CITY ATTORNEY AND WATER ATTORNEY <br />City Attorney Kelly stated that no follow-up is requested at this time regarding the real <br />property acquisitions and dispositions or the annual performance review of the City <br />Attorney and Water Attorney.
