Louisville Local Licensing Authority <br />Meeting Date: November 19, 2001 <br /> <br />application deficiencies in her memo of November 13, 2001. <br /> <br />Attorney Light stated that the lease agreement is dated September 5, 2001 and states that the term of <br />the lease is for five years from the commencement date. Light noted that under the "term" section <br />of the lease there was a hand noted change to the commencement date changing it from 2001 to <br />2006. <br /> <br />Attorney Light requested the applicant speak to this inconsistency and explain why the change was <br />made. <br /> <br />Mr. Bic!der stated that he thought we had requested the date be changed, so he and Mr. Chick <br />amended the agreement. <br /> <br />Member Jeffers asked Mr. Bickler if he changed the date to reflect when the term of the lease ends. <br />Mr. Bickler stated that was correct. <br /> <br />Deputy City Clerk Bolte stated there was also a discrepancy between the lease expiration date on the <br />lease agreement, which should be September 5, 2006 and the lease expiration date given in answer to <br />question #11 on the transfer application of October 5, 2016. <br /> <br />Attorney Light stated that the other discrepancy noted relates to question #10 of the transfer <br />application, which conflicts with the answer given by Mr. Bickler on question #21 of his Individual <br />History Record. This question asks whether a liquor license has ever been previously held by the <br />applicant, which Mr. Bictder indicated as "no" on the application, but "yes" on his individual history. <br /> <br />Member Jeffers asked Mr. Bickler the hours of operation for Karen's. Mr. Bic!der stated they are <br />open from 6:30 a.m. until 2:00 p.m. on weekdays, and 7:30 a.m. until 2:00 p.m. on weekends. <br /> <br />Chairperson Lipton called for any closing comments. <br /> <br />Attorney Barnett stated that he wished to remind the Authority that the purpose of the hearing is to <br />determine whether there was material misrepresentation or statements of falsehood contained in the <br />transfer application, and whether any such findings affect the determination made by the Authority <br />that the applicant is of good moral character. Barnett stated that the Authority could also consider <br />the types of offenses committed by the applicant, and a determination made as to whether or not <br />they relate to the character of the applicant. <br /> <br />Attorney Carney stated that he is open to whatever determination the Authority makes. Carney <br />stated that he couldn't argue that mistakes were made, but that he would request that the Authority <br />give Mr. Biclder and Mr. Loos a chance. <br /> <br />Chairperson Lipton asked if there were any other matters to be considered. Hearing none, <br />Chairperson Lipton closed the public hearing and called for member comments or discussion. <br /> <br />Member Kimmett moved that the Authority find the Applicant has demonstrated it has legal <br />possession of the premises for the one-year period of the license, that there were no material <br />misrepresentations or false statements made on the transfer application, that the applicant is not <br />prohibited from holding a liquor license by C.R.S.
