Louisville Local Licensing Authority <br />Meeting Date: November 19, 2001 <br /> <br />Neighborhood Grill & Bar - Hotel & Restaurant Liquor License - 594 S. McCaslin <br />Blvd. <br /> <br />MemberJeffers moved to approve the consent agenda. Member Koertje seconded the motion. All <br />members were in favor, motion carried. <br /> <br />AUTHORITY BUSINESS <br /> <br />Proposed Findings of Fact and Order of Dismissal - Bungalow Wine & Liquors <br />Inc., d/b/a Bungalow Wine & Spirits - Retail Liquor Store Liquor License - 645 S. <br />Boulder Road. <br /> <br />Attorney Sam Light stated this item had been continued from the October 29, 2001 meeting in <br />order to allow the City and the Licensee to present evidence that a portion of the terms of the <br />October 29, 2001 Stipulation and Agreement have been met. Attorney Light reviewed that the <br />licensee was required to sell the retail liquor store and provide proof of that sale along with affidavits <br />from the licensee and the purchaser stating that such sale was an arms length transaction, that the <br />licensee transferred all its rights, fitle, ownership and interest, and that the former licensee will not <br />have any type of relationship with the liquor store. <br /> <br />Attorney Light stated that several documents were delivered by the former licensee to the Authority <br />Secretary on Friday, November 16th along with some additional documents today. He noted the <br />documents as a signed Bill of Sale, List of Equipment, Fixtures & Furniture, Assignment of Security <br />Deposit, Settlement Statement, Inventory Report, and Affidavits from the former licensee and new <br />licensee confirming the sale as an arms length transaction. <br /> <br />Attorney Light stated that several questions remained that have since been clarified by Prosecuting <br />Attorney Mark Shapiro and the attorney for the licensee K.Y. Kang. Attorney Light stated that both <br />attorneys had inquired as to whether their presence was required at this meeting and that he advised <br />them that if any questions remained, the matter could be continued to the next regular meeting of <br />the Authority. Alternatively, Light stated that Attorney Shapiro has already drafted an Order for <br />Dismissal which is contained in the member packets, and that the Authority could approve such <br />dismissal at their pleasure. <br /> <br />As an informational item, Attorney Light stated that the former licensee, Mr. Chan Soo Lee, formed <br />a new corporation on September 29, 2001 named Bungalow Wine & Spirits, Inc. Attorney Light <br />stated that Mr. Lee's attorney advised him that in order for Mr. Lee to retain his current visa, he <br />must maintain a business entity in the United States. Light stated that his office would periodically <br />check the activities of Mr. Lee's new corporation to make sure there are no violations of the <br />Stipulation and Agreement. <br /> <br />Member Jeffers stated that the next item on the Authority agenda is the transfer application for Seo, <br />Inc., d/b/a Bungalow Wine & Spirits, and questioned the order in which these two items should be <br />handled. Member Jeffers stated that every other page of the lease agreement was missing and that <br />the sublease agreement had not been signed. <br /> <br />Deputy City Clerk Bolte stated that the applicant did submit an entire lease, and apologized for the <br />clerical error when putting the member packets together.
