Louisville Local Licensing Authority <br />Meeting Date: November 19, 2001 <br /> <br />agreement had not been received by the City Clerk's Office. <br /> <br />Attorney Light stated that the Authority could delay a decision on agenda item VI. A, and direct <br />questions concerning the transfer application and subsequent sale to the representative present for <br />the new licensee. <br /> <br />Member Jeffers asked if the new licensee had been issued a temporary permit and if they would be <br />allowed to continue to operate on such permit should the Authority continue this matter to the next <br />regular meeting. Clerk Bolte stated that the transfer applicant Seo, Inc. had been issued a temporary <br />permit to operate and that the permit is valid for 120 days. <br /> <br />Authority Chairperson Lipton called the attorney for Seo, Inc. forward to answer a few questions. <br /> <br />Attorney Carl Ream introduced himself to the Authority and stated that he was the attorney for the <br />new licensee and that he also represented his client at the November 4, 2001 closing. Attorney <br />Ream stated his confirmation that the sale took place and presented the Authority with a signed and <br />notarized copy of the executed Bill of Sale. <br /> <br />Member Jeffers asked Attorney Ream if he had a copy of the executed lease assignment. Attorney <br />Ream stated that the landlord requested the transaction be handled through a sublease agreement, <br />however they have not yet received the signed copy from the landlord. Attorney Ream stated that <br />he expected to receive the signed sublease agreement next week. <br /> <br />Member Jeffers stated that his questions regarding agenda item VI. A had been answered. <br /> <br />Chairperson Lipton called for any other Authority comments or questions. <br /> <br />Hearing none, Member Jeffers moved to approve the Findings of Fact and Order of Dismissal for <br />Bungalo~v Wine & Liquors, Inc., d/b/a Bungalow Wine & Spirits, 645 S. Boulder Road. Member <br />KJmmett seconded the motion. Roll Call Vote: Kimmett - yes, Koertje - yes, Lipton - yes, Jeffers - <br />yes. All members in favor, motion carried. <br /> <br />Transfer Application - Seo, Inc., d/b/a Bungalow Wine & Spirits - Retail Liquor <br />Store License w/Delivery Permit - 645 S. Boulder Road. <br /> <br />Chairperson Lipton asked if there was a signed affidavit consenting to the transfer of this liquor <br />license. Clerk Bolte confirmed that there was a signed Affidavit of Transfer and Statement of <br />Compliance included in the transfer application packet. <br /> <br />Member Jeffers asked Attorney Light and Clerk Bolte if the transfer application was complete <br />pending receipt of the signed sublease agreement from the landlord. Clerk Bolte stated that there <br />were a couple of minor corrections that needed to be made as outlined in Authority Attorney <br />Harrington's memo of November 9, 2001. <br /> <br />The Authority discussed whether or not a hearing should be set for the transfer application. <br />Attorney Sam Light stated that it is not the policy of the Authority to grant a liquor license absent <br />proof of possession of the premises.
