Louisville Local Licensing Authority <br />Meeting Date: December 17, 2001 <br /> <br />Member Jcffers asked how many drinks the bartender stated this person had been served. Officer <br />Lanphere noted that the case status is still open, and stated that he would follow-up with any <br />additional reports for the next meeting. <br /> <br />Member Jeffers stated that because the incident was so long ago, he doubted the police department <br />xvould be able to offer any additional information. He stated his preference for a special prosecutor <br />to investigate the incident to determine whether or not there is any additional evidence to present. <br /> <br />McmbcrJeffers moved to amend the Show Cause Order dated November 30, 2001, to include <br />selling/serving to an apparently intoxicated person, and selling/serving to a visibly intoxicated <br />person with regard to the DUI arrest portion of the incident report; that the hearing be set for <br />January 28, 2002, and that Attorney Mark Shapiro be requested to include these latest allegations as <br />part of his current investigation. Member Kimmett seconded the motion. Roll Call Vote: Koertje - <br />yes, IGmmett - yes, Lipton - yes, Jeffers - yes. All members were in favor, motion carried. <br /> <br />B. Incident Report-Blue Parrot Caf6 (10/09/01) Tabled from 10/29/01 & 11/19/01 <br /> <br />Member Jeffers stated that he had asked Mr. Weissmann the hours of operation earlier in the <br />meeting, and that based on his answer, he has concerns about an employee drinking after business <br />hours. <br /> <br />Members discussed whether there is a provision prohibiting the consumption of alcohol after <br />normal business hours, but prior to 2:00 a.m. as permitted with a Hotel & Restaurant liquor license. <br /> <br />Members also discussed that the police report does not specifically state that the person ~vas <br />drinking at the Blue Parrot. <br /> <br />Office Lanphere stated that there ~vas a part of the police report missing which could provide <br />ans~vers for the Authority as to where the individual was drinking. He stated that he would follow <br />up with the supplemental report at the next meeting. <br /> <br />Member Koertje moved to table this incident report to the next regularly scheduled meeting January <br />28, 2002. Member Kimmett seconded the motion. All members were in favor, motion carried. <br /> <br />C. Incident Report - Gentleman Jim's (11/05/01) <br /> <br />Members briefly discussed the details of the report and the results of the BAC test. <br /> <br />Member Kimmett moved to order a Show Cause Hearing to be held January 28, 2002 for <br />sales/service to an apparently intoxicated and visibly intoxicated person; and that Steve Barnett be <br />appointed Special Prosecutor. Chairperson Lipton seconded the motion. Roll Call Vote: Kimmett <br />- yes, Koertje - yes, Lipton - yes, Jeffers - yes. All members were in favor, motion carried. <br /> <br />SECRETARY'S REPORT <br /> <br />Deputy City Clerk Bolte stated that copies of the January 2002 (1~t Qtr.) "Louisville Liquor Lore" <br />had been distributed to members for their review and approval.
