City Council <br />Meeting Minutes <br />November 17, 2020 <br />Page 5 of 9 <br />Staff finds the application meets all criteria for a Special Review Use including the <br />proposed hours of operation, it also meets the intent of the South Boulder Road Small <br />Area Plan, contributes to the economic prosperity of the area, and is appropriately <br />designed and improves site conditions. <br />The applicant is asking for three waivers with the proposal. The first is for a reduced <br />setback on South Boulder Road. Staff supports the request to meet the goals of the Small <br />Area Plan and activate the space along the street and it facilitates parking. The second <br />waiver is for reduced landscaping from 30% to 28%, staff supports this waiver as it is <br />such a small, constrained lot. The design is high quality and is landscaped well. The third <br />is a parking waiver for a smaller island. Staff supports this as it does allow for one <br />additional parking space. <br />The retailers in this development have a shared parking agreement however staff still <br />reviews the application to determine if there is enough shared parking to add this use. <br />Staff's review shows there is enough parking given the mixes of uses and the time <br />demands and does not have concerns the site is underparked. <br />The proposal complies with the remainder of the CDDSG standards and PUD <br />requirements. Staff finds the application meets all the criteria for approval of a special <br />review use. <br />The easement vacation would vacate an existing water and sewer easement and <br />establish a new water and sewer easement which allows reconstruction of an existing <br />public water line in disrepair. This request meets all requirements of the code. <br />Staff recommends approval of Ordinance 1803, Series 2020 and Resolution 90, Series <br />2020 <br />Kelly Siu, representing the applicant, reviewed the architecture of the building, the site <br />plan, and explained the reasons for the waiver requests. <br />Joshua Martinsons, the applicant, gave an overview of the vision of the project to be a <br />family friendly food hall that will be a benefit to this location and the City. <br />Public Comments — None <br />Councilmember Lipton noted that parking for this entire area is complicated and might <br />have to be redone at some point. He asked when that would be required. Ritchie stated <br />this proposal would not trigger that change on the adjacent property. She did agree this <br />will be an issue when or if the adjacent property redevelops. As proposed, it is sufficiently <br />parked with the shared parking agreement. <br />Public Comments - None. <br />
