Recorded as received. <br />CLEMENTINE COMMONS <br />SUBDIVISION AGREEMENT <br />THIS CLEMENTINE COMMONS SUBDIVISION AGREEMENT ("Agreement') is made <br />and entered into this day of March, 2019 ("Effective Date"), by and between the <br />CITY OF LOUISVILLE, a Colorado home rule municipal corporation, in the County of <br />Boulder, State of Colorado ("City"), and CLEMENTINE TOWN HOMES, LLC, a <br />Colorado limited liability company ("Subdivider"). <br />WHEREAS, Subdivider is the owner and subdivider of the property within the Final <br />Subdivision Plat ("Plat') for the Clementine Commons Subdivision ("Subdivision"), which <br />Plat is recorded in the Office of the Clerk and Recorder in Boulder County under Reception <br />No. 03115166 and incorporated herein by reference, and which Plat has been <br />reviewed and approved by the Planning Commission and City Council of the City by City <br />Council Resolution 18, Series 2018; and <br />WHEREAS, the subdivision regulations of the City require that Subdivider enter into a <br />subdivision agreement with the City relative to improvements related to the subdivision of <br />land; <br />NOW, THEREFORE, in consideration of the foregoing, the parties hereto promise, covenant <br />and agree as follows: <br />1.0 GENERAL CONDITIONS <br />1.1 Subdivision Obligation; Scope of Agreement. Subdivider shall be liable for <br />performance of the covenants set forth herein. This Agreement is intended to apply to <br />development of Clementine Commons. The development and subdivision plat to which this <br />Agreement applies are sometimes referred to herein as the "Subdivision" or "Plat." <br />1 <br />
