Boulder County, CO 03715259 2 of 62 <br />Subdivider agrees that an additional subdivision agreement or development agreement shall <br />be required prior to the recording of any development approvals or issuance of any permits <br />for subdivision or development outside of that approved by City Council Resolution No. 18, <br />Series 2018 (approving Clementine Commons). The City shall also have the further right to <br />require a separate subdivision and/or development agreement as a condition of approval of <br />any further subdivision plat or planned unit development (PUD) plan approval, and withhold <br />any building permits for any property within such further subdivision or development. <br />1.2 Engineering Services. Subdivider agrees to furnish, at its expense, all necessary <br />engineering services relating to the design and construction of the Subdivision and the <br />Schedule of Improvements described in Exhibit A (`Subdivider Improvements"), attached <br />hereto and incorporated herein by this reference. Said engineering services shall be <br />performed by or under the supervision of a Registered Professional Engineer or Registered <br />Land Surveyor, or other professionals as appropriate, licensed by the State of Colorado, and <br />in accordance with applicable Colorado law; and shall conform to the standards and criteria <br />for public improvements as established and approved by the City as of the date of submittal <br />to the City. <br />1.3 Construction Standards. Subdivider shall construct all Subdivider Improvements. <br />All Subdivider ]mprovetnents shall be constructed in accordance with (i) the plans and <br />specifications approved in writing by the City for the Subdivider Improvements (`Approved <br />Plans"), (ii) the Plat, (iii) the Clementine Commons Final PUD Development Plan ("Plan,,), <br />and (iv) the City's construction specifications applicable at the time of construction plan <br />approval. City approval of construction plans for the Subdivider Inprovements will be <br />granted only after receipt of the required improvement Guarantee, and such approval will <br />continue in effect for three (3) years from the date of such approval. In the event that <br />Subdivider desires to connnence or perform any construction work based on the Approved <br />Plans after such three (3) year period, Subdivider shall resubmit the subject construction <br />plans to the City for reexamination for compliance with standards and criteria for public <br />2 <br />
