Report of Changes - Trinh, Inc. d/b/a TuLien's Restaurant - Modification of <br />Premises - 808 Street <br /> <br />Vice-Chairperson Paige noted it appeared the changes would actually make the <br />establishment smaller. Deputy City Clerk Hanson reported TuLien's is putting up walls <br />to completely separate the new portion for a beauty shop. City Clerk Varra commented <br />her office had noticed that construction was going on at the property and sent notice <br />they needed to file modification of premises. Attorney Light asked if they continued to <br />serve during construction. They did continue to operate during construction. He noted <br />there needed to be a change on the application to indicate that this was a permanent <br />change. <br /> <br />Mulvahill moved the modification of premises be approved with the changes requested <br />to the application - complete Section 7c to correctly state when the changes will take <br />effect. Lipton seconded. Roll Call Vote: Paige-yes, Lipton-yes, Mulvahill-yes, Wilson- <br />yes and Rommelfanger -yes. <br /> <br />E. Renewal Application - Seo, Inc. d/b/a Bungalow Wine & Spirits - Retail <br />Liquor Store License - 645 S. Boulder Road <br /> <br />Vice-Chairperson Paige commented the renewal indicated the current lease expires in <br />March 2004. Deputy City Clerk Hanson was asked if a new lease had been submitted. <br />Hanson stated she has been in contact with the owner and to date has not received a <br />new lease. <br /> <br />Wilson moved the Authority table this item until the next meeting. Lipton seconded. <br />Roll Call Vote: Paige-yes, Lipton-yes, Mulvahill-yes, Wilson-yes and Rommelfanger - <br />yes. <br /> <br />F. Show Cause Hearing - Celtic Way, L TD d/b/a Druids Arms - <br />Tavern License- 809 Main Street - Continuance Requested <br /> <br />Mulvahill noted the Authority met the responsibility of adequate notice for the show <br />cause hearing. Wilson questioned the appointment of Shapiro as prosecuting attorney. <br />Attorney Light reported the two other candidates had conflicts of interest preventing <br />them from acting as prosecutors in this matter. Martin Staab and Stefan <br />Fredricksmeyer both expressed interest in future appointments. Attorney Light <br />explained there might be conflict with having the prosecuting attorney for the City also <br />prosecute in these show cause hearings. The possible conflict involves prosecuting in <br />the criminal arena and the civil arena at the same time. Light and Staab will look further <br />into the rules of conduct on this matter.
