<br />Louisville Local Licensing Authority <br />Meeting Date: January 26, 2004 <br />Page 4 of 5 <br /> <br />Wilson moved the continuance be granted and the show cause hearing be set for the <br />next regular meeting of the Authority. Mulvahill seconded. Roll Call Vote: Paige-yes, <br />Lipton-yes, Mulvahill-yes, Wilson-yes and Rommelfanger -yes. <br /> <br />Light clarified a continuance can be granted by the secretary if a matter has not been <br />set and noticed. This does not clearly apply to a show cause hearing and he advised <br />the Authority they could make the change if they felt it necessary. Otherwise, they could <br />continue to have a request for continuance in a show cause hearing come before the <br />Authority on a case-by-case basis. Authority members agreed they would like to see <br />the show cause requests on a case-by-case basis. <br /> <br />POLICE DEPARTMENT REPORTS <br /> <br />B. Incident Report - Melting Pot - 12/20/03 - Continued from last meeting <br /> <br /> <br />C. Incident Report - Chili's - 12/22/03 - Continued from last meeting <br /> <br />Detective Lanphere reported after speaking with Detective Gordanier on these two <br />items, there was no further follow-up that took place or would take place. <br /> <br />A. Incident Report - Carrabba's Italian Grill- 12/30/03 <br /> <br />This incident involved a driver being stopped for apparent driving under the influence, <br />who stated she had been at Carrabba's and was trying to get home. There was no <br />other information or evidence to substantiate that or support investigation at Carrabba's. <br /> <br />There was discussion by the Authority concerning the follow-up with the restaurants in <br />all three of these reports. Detective Lanphere stated not every DUI stop would result in <br />an investigation of the establishment. He and Detective Gordanier continue to support <br />the training of officers in reporting and follow-up for liquor enforcement. <br /> <br />A question of sending a letter to Carrabba's was raised. Discussion followed and the <br />members agreed there was not enough evidence presented to justify a letter to <br />Carrabba's. <br /> <br />Detective Lanphere brought to the Authority's attention problems with establishments <br />making modifications to their premises without notifying the Authority. In particular, he <br />and City Clerk Varra spoke of Louisville Liquors plan to sell burritos from their retail <br />liquor licensed store. Two other establishments, TuLien's responded to a letter <br />concerning modifications, however the Melting Pot has not. Varra reported she had <br />sent the Building Department to Louisville Liquors and would request the Police <br />Department do a site visit. Attorney Light read from the Liquor Code and asked how the <br />.liquor was delivered at the Melting Pot and if changes were occurring there. Varra <br />responded yes.
