<br />Louisville Local Licensing Authority <br />Meeting Date: February 23, 2004 <br />Page 3 of 6 <br /> <br />Member Mulvahill reminded the Authority the issue on this renewal was the lease to <br />cover the period of the license. He felt the letter from the landlord expressed their intent <br />to renew the lease and moved that the Authority approve the renewal contingent on the <br />execution of the lease. Wilson seconded. Roll Call Vote: Koertje - yes, Paige-yes, <br />Mulvahill-yes and Wilson-yes. The motion carried. <br /> <br />B. Show Cause Hearing - Celtic Way, L TD d/b/a Druids Arms - Tavern License <br />- 809 Main Street <br /> <br />Chairperson Koertje called for counsel to enter their appearances in this matter. Mark <br />Shapiro as Attorney for the Authority and Michael Rennich as Attorney for Druids Arms. <br /> <br />Shapiro reported there was a Stipulation and Agreement entered into. Mr. Rennich <br />stated the stipulation was fine with his client. Rennich then read from the ordinance <br />concerning fine in lieu of suspension. He reported Druids Arms had kept track of <br />receipts for two weeks on Wednesday, Thursday and Friday. The gross receipts for the <br />first week were $921.00 and $961.00 for the second week. With an average and then <br />taking 20%, the total would be under $200.00 for the fine. Druids Arms would petition <br />the Authority for a fine of $200.00 instead of serving the one-day suspension. If the <br />Authority approves the fine in lieu, he will tender the petition. He asked the Authority to <br />act on the stipulation with an approval and he would tender the petition. The Authority <br />could discuss and approve that at this meeting. <br /> <br />Mulvahill commented the first item would be whether or not the stipulation is <br />appropriate. In his opinion, it is, with three-day suspension, one day served and two <br />days held in abeyance. He noted Druids Arms had sent 5 persons to liquor training in <br />January. <br /> <br />The question was asked whether Druids was under any suspension at this time. Mr. <br />Rennich responded they are not. In fact, it has been two years since there were any <br />incidents brought before the Authority. <br /> <br />Mr. Shapiro reported Mr. Rennich and Druids Arms were very cooperative and it had <br />been over two years since their last violation. He was asked if he was involved in <br />calculating the fine in lieu. Mr. Shapiro responded he was not. <br /> <br />Mr. Rennich explained how the fine was calculated. He was asked how using Saturday <br />would change the figures. He thought it would change the estimate to about $250.00. <br /> <br />Chairperson Koertje asked Authority Attorney Bleau if the rules required the suspension <br />be set within thirty days of this hearing. She answered yes. Koertje explained the <br />stipulation procedure.
