<br />Louisville Local Licensing Authority <br />Meeting Date: February 23, 2004 <br />Page 4 of 6 <br /> <br />Discussion centered on the dates for suspension. <br /> <br />Mulvahill moved to approve a modified Stipulation and Agreement to include the <br />suspension date to be served on Friday, March 12,2004. Wilson seconded. Roll Call <br />Vote: Koertje - yes, Paige - no, Mulvahill-yes and Wilson-yes. The motion carried. <br /> <br />Chairperson Koertje then called for consideration of the Petition for fine in lieu of <br />suspension. <br /> <br />Member Wilson expressed her belief the violation occurred on a weekend, and it is <br />reasonable the fine be based on Thursday, Friday and Saturday receipts. Mulvahill <br />concurred. Mr. Rennich was asked if the parties involved in the incident had been to <br />liquor training. The answer was yes. <br /> <br />Member Mulvahill calculated if the fine was based on the weekend days, the fine would <br />be around $240-$250. <br /> <br />Mr. Rennich stated if the Authority would take Ms. Charnley's word for the gross <br />receipts including the Saturday instead of the Wednesday, bringing the fine to $240- <br />$250, that would be acceptable. <br /> <br />Mulvahill moved the Authority approve the petition for permission to pay fines in lieu of <br />suspension and set the fine in the amount of $240.00 based on the information provided <br />with respect to gross receipts for the 3-day period Thursday, Friday and Saturday. <br />Wilson seconded. Roll Call Vote: Koertje - yes, Paige - no, Mulvahill-yes and Wilson- <br />yes. <br /> <br />Mr. Rennich asked when the Authority would like the fine paid. <br /> <br />Mulvahill moved to set the deadline for payment of the fine in lieu of suspension on or <br />before 5:00 PM on March 11, 2004 with the understanding that if it is not paid in a timely <br />fashion, the suspension for March 12, 2004 becomes effective. Wilson seconded. <br />Koertje - yes, Paige - abstained, Mulvahill-yes and Wilson-yes <br /> <br />C. Report - Modification of Premises at Louisville Liquor - Retail Liquor Store <br />License - 1140 Pine St. #1 <br /> <br />Detective Gordanier updated the Authority on the wall being built at Louisville Liquors as <br />well as anonymous allegations that liquor was being transferred from this store to one in <br />Westminster. The owner was in to talk to her and was instructed to get proper permits <br />and submit a modification of premises to the Authority. To this date, he has done <br />neither. Detective Gordanier has been in contact with the State Liquor Enforcement <br />and will continue to follow-up on what is happening at this establishment.
