<br />Louisville Local Licensing Authority <br />Meeting Date: March 29, 2004 <br />Page 6 of 7 <br /> <br />Hanson included a copy of Louisville Liquor Lore for the members along with a copy of <br />the training materials presented at the Liquor Authority training held in Broomfield on <br />March 13, 2004. <br /> <br />Member Wilson commented the training was very helpful and informative. She <br />spoke with the state inspectors about "sting" operations and they will perform those if <br />the police department chooses not to. Discussion centered on the relationship with <br />the police department and whether stings were necessary as a matter of course or <br />when a problem is thought to be occurring. Concerns were expressed about adults <br />purchasing for juveniles, relationships with licensees and entrapment issues. The <br />Authority asked Detective Lanphere to check with the Chief of Police concerning the <br />policy concerning stings and report back at the next meeting. <br /> <br />AUTHORITY ATTORNEY'S REPORT <br /> <br />Attorney Light stated there is a bill pending in the State legislature concerning stings <br />and enforcement rights of local governments when a violation is identified due to a <br />sting. <br /> <br />Light also clarified the timing of the application for modification of premises. The rules <br />concerning alterations get technical and he thought it was important for the filing to be <br />done before sums of money had been spent on changes. <br /> <br />Attorney Light was asked several questions concerning the special events permit that <br />was in the police department report. Since a show cause hearing was scheduled, he <br />thought it appropriate for those questions to be addressed at the hearing. <br /> <br />AUTHORITY COMMENTS <br /> <br />A. Change of License Class - White Lodging d/b/a Residence Inn and Courtyard <br />by Marriott - Letter of Request - For Discussion Purposes <br /> <br />The question was raised if the change of class had to be treated as an application for a <br />new license. The answer is yes. <br /> <br />Attorney Light recommended until the Authority had a new application submitted, they <br />not offer an opinion. He also stated he wanted to investigate if this would involve an <br />ordinance or by-law change. Mulvahill moved the Authority authorize Attorney Light to <br />speak with Steve Lee, attorney for White Lodging, concerning what they are looking for <br />with this letter. Paige seconded. Roll Call Vote - Koertje-yes, Paige-yes, Lipton-yes, <br />Wilson-yes and Mulvahill-yes.
