Don Ross says that when a variance comes to the Board, they can use the points. in this Section as a guideline, and if they don't agree with any of the points insofar as the application is concerned, maybe that would be a cause for not granting that variance. Pickett says that it's not any one of those, it's all of them. Chairman agrees that all of those, the Board has used. Reed comments that there is a lot of broad terms in there, and a lot of room for argument. Ferris says that he thinks it would be a good idea to go through Section 8 at every meeting and go down the line and discuss each individual problem, so the Board would be covered on the tape if their judgement was questioned. Davies is trying to fit Section 8 into the hearing. He asks if they've satisfied themselves that there are (certain conditions), and then ask the questions if the physical circumstances or conditions exist, and then go right down the list. Pickett says that if the Chairman would close the Public Hearing with that Section 8 right there - Ferris comments that he thinks it ought to go up to the applicant so he'll have a chance for rebuttal. Chairman says.that-they.have to open the Public Hearing with the normal proceedings, and then they go to that . . . Davies thinks it would be a good idea because if they got a tough case, then they could fill the whole order right there. 4. Section 9. Minutes and Records, Secretary. Steve Ferris, Chief Building Official is thought best for the job of secretary. 5. General Suggestions and Ideas on the By -Laws. Pickett suggests that if Section 3 and Section 6 were in the opening of the hearing, (the Quorum and the Continuance), and if there were a number of votes necessary and if there,were only 4 members, and if that were included in the opening of the Public Hearing everyone would be happy, and also if there were only 4 members they could read the continuance. He thinks that it would be a good idea to start it right there, because if there were only 4 members, there might not be a need to go any further. Ferris suggests typing.up a guideline.
