COAL CREEK ASSOCIATES <br />Chairman Sears opened the pntb': is hearing. <br />in the Louisville Times January 10, 1990. <br />APPLICANT'S PRESENTATION: <br />Noti;:e was published <br />John Jorgenson, Hurst & Associates, representing Coal Creek <br />Ranch. Jorgenson stated that we are requesting a variance floor <br />the Louisville's flood plain regulations to allow placement of <br />fill in the 100 year flood plain within the Coal Creek•Filing Nc. <br />3. A variance allows construction to begin on Coal Creek Ranch <br />Filing No. 3 while the flood insurance rate map (FIRM) revision <br />is t.eing processed by the Federal Emergency Management Agency <br />(FEMA). We anticipate the FIR^ ievision process to be completed <br />in April <br />Chairman Sears asked if theie was anyone that would like to speak <br />in favor of or in opposition to this proposal? NONE <br />STAFF PRESENTATION: <br />Wood referred to the .s•taff report of January 23, 1990. Staff <br />recommends approval of the special exemption permit for Coal <br />Creek Ranch Filing No. 3. <br />BOARD COMMENTS: <br />Fyne asked why the Planning Commission made the stipulation ``iat <br />prior to development the city shall have in it:_ possession a <br />Letter of Map Revision from FEMA or the applicant shall apply to <br />the Board of Adjustment and receive approval for a f'loodplain use <br />permit prior to filing any affected lot? <br />Wood stated this was basically a recommendation to Planning <br />Commission from staff because the Planning Commission does not <br />have jurisdiction over the flood plain only the Board of Appeals <br />does. <br />Smith stated that the major basin needs to be filled which is the <br />worst case, my concern is from now until 1992, when rest of the <br />road work is started. <br />Pendergrast asked what the time table is on this project? <br />Jorgenson stated it will take at least one month to do all of the <br />dirt work on the site. Utility construction is probable another <br />month after, the whole process will take about 120 days. We will <br />not be able to get a building permit until all of the utilities <br />are in. <br />Boards concern was for the liability of any damage.
