• <br />LOUISVILLE BOARD OF ADJUSTMENT <br />STAFF REPORT <br />JANUARY 23, 1990 <br />APPLICANT: COAL CREEK ASSOCIATES, REPRESENTED BY JOHN W. JORGEN- <br />SON P.E. HURST AND ASSOCIATES. <br />LOCATION: COAL CREEK RANCH FILING NO.3, SOUTH OF DILLON ROAD, <br />EAST OF THE GOLF COURSE, NORTH OF THE HEALTH PARK. <br />ZONING: PLANNED COMMUNITY ZONE DISTRICT - (PCZD) PLANNED RESI- <br />DENTIAL (PR). <br />REQUEST: <br />The applicant is requesting a special exemption permit to allow <br />placement of fill material in the 100 year flood plain of Coal <br />Creek. <br />BACKGROUND: <br />The applicant is requesting a special exemption permit to place <br />fill material and construct single family homes on lots 1-3, 6- <br />15, 29 and 78-84 of Coal Creek Ranch Filing No. 3. <br />The Planning Commission on November 14, 1989 recommended approval <br />of Coal Creek Ranch Filing No. 3 to City Council with a condition <br />that; <br />Prior to the development of lots shown to be within the <br />existing 100 year flood plain (1-3, 7-15, 29, 78-84) the <br />city shall have in its possession a Letter of Map Revision <br />(LOMR) from the Federal Emergency Management Agency (FEMA) <br />confirming base flood_elevations as amended will not en- <br />croach upon any portion of Filing #3. In lieu of the (LOMR) <br />the applicant shall apply to the Board of Adjustment and <br />receive approval fro a floodplain use permit prior to filing <br />any affected lot. <br />The special exception permit, if approved, would allow, with <br />building permit approval, construction of single family homes on <br />the subject lots while the Federal Emergency Management Agency is <br />processing a revision to the Flood Insurance Rate Map (FIRM). <br />Flood management regulations require that the lowest floor of a <br />permanent structure be elevated to a point two (2) feet'above the <br />hundred year flood elevation. <br />Coal Creek Filing No. 3 has not been approved by City Council. <br />Final development plans are scheduled to go before City Council <br />on February 6th pending submittal of additional agreements with <br />the Health Park. <br />
