STAFF COMMENTS: <br />Section 17.56.170(C)(1) of the Municipal Code gives jurisdiction <br />to the Board of Adjustment to issue special exemption permits for <br />filing within the flood regulatory district provided that the <br />following criteria be met; <br />1. The fill will have a beneficial purpose; <br />2. The fill will not reduce the flood storage capacity of Coal <br />Creek. <br />3. The fill will not decrease the ability of the flood way <br />channel to efficiently convey a 100 year flood event. <br />The engineering division has reviewed and supports the conclu- <br />sions in the flood plain analysis provided by the applicant. That <br />the proposed action will comply with the above criteria. <br />STAFF RECOMMENDATION: <br />Staff recommends that the Board of Adjustment approve the special <br />exemption permit for the following reasons: <br />1.The fill will have a beneficial purpose, and will have no <br />adverse down stream impacts. <br />2. The fill and or structures will not reduce the flood storage <br />capacity of Coal Creek. <br />3. The fill and or structures will not decrease the ability of <br />the flood way channel to effectively convey a 100 year <br />event. <br />
