Sisk wanted notification given to residents affected by the project as it moves into their neighborhood. Sisk moved that Council authorize the Mayor to execute the contract on behalf of the City in the amount of $1,115,788.25 with Western Mobile/Boulder and authorize staff to execute change orders up to $25,000 for the street projects identified as Nos. 1 - 8 inclusive on the Council Communication, seconded by Keany. Roll call was taken. Motion passed by a 6 - 0 vote with Howard being absent. ORDINANCE NO. 1242, SERIES 1996 - AMENDING THE PLANNED UNIT DEVELOPMENT REGULATIONS CONTAINED IN CHAPTER 17.28 OF THE LOUISVILLE MUNICIPAL CODE TO INCORPORATE INTO SUCH REGULATIONS SPECIFIC REFERENCES AND REQUIREMENTS CONCERNING COMMERCIAL AND INDUSTRIAL DEVELOPMENT DESIGN GUIDELINES; TO SPECIFICALLY ADDRESS THE EFFECT OF APPROVAL OF A PRELIMINARY PLANNED UNIT DEVELOPMENT PLAN, AND TO MAKE OTHER AMENDMENTS TO CHAPTERS 15.04, 17.16 AND 17.28 OF THE LOUISVILLE MUNICIPAL CODE IN CONNECTION THEREWITH - 2ND READING - PUBLIC HEARING - CONTINUED FROM 6/03/97 MEETING Griffiths read by title only Ordinance No. 1242, Series 1997, "An ordinance amending the Planned Unit Development regulations contained in Chapter 17.28 of the Louisville Municipal Code to incorporate into such regulations the Louisville Commercial Development Design Standards and Guidelines; to incorporate into such regulations specific references and requirements concerning commercial and industrial development design Standards and Guidelines; to specifically address the effect of approval of a preliminary planned unit development plan, and to make other amendments to Chapter 17.28 of the Louisville Municipal Code in connection therewith." Davidson opened the public hearing. Paul Wood, Planning Director, pointed out that the relationship between the ordinance and the CDDSG remained unchanged from first reading. Section 4 of the ordinance adopts the CDDSG as an appendix to Chapter 17.28 of the Municipal Code which contain the City's PUD regulations. The ordinance also retained to Council the flexibility to waive or modify any requirements of the CDDSG within the PUD process. The ordinance requires that the Standards and Guidelines apply to both commercial office and commercial retail. The ordinance clarified that a preliminary approval of a preliminary PUD plan did not create a vested property fight to develop under, rather approval of a preliminary PUD entitled the developer to proceed with a final PUD submittal. Site coverage would be 70% for building coverage, parking, and drives, 30% for open space coverage which may include oriented areas, such as sidewalks and hard-scaped plazas within the open space areas and pedestrian gathering places. He pointed out that in Council's packet was a June 12, 1997, letter from Koebel & Co. asserting their position that the Commercial Development Design Guidelines would not apply to either Centennial Valley Business Park or the Centennial Valley Market Place.
