Davidson stated that seeing none, Council would move on taking no action. <br /> <br />ORDINANCE NO. 1260, SERIES 1997 - REZONING 152 ACRE PARCEL FROM <br />INDUSTRIAL AND CB TO SF-E - BOULDER COUNTY LAND VENTURE - NORTHEAST <br />CORNER OF DILLON ROAD AND SO. 104TH STREET - 1ST READING - PUBLIC <br />HEARING (PUBL. LSVL. TIMES 5/17/97) <br /> <br />Griffiths read by title only Ordinance No. 1260, Series 1997, "An ordinance amending Title 17 of the <br />Louisville Municipal Code entitles "Zoning" by rezoning certain property owned by Boulder County <br />Land Venture." <br /> <br />Susan Griffiths, City Attorney, stated that the process for rezoning is a quasi-judicial process. The <br />issue is whether or not the rezoning complies with Louisville Code criteria for rezoning. <br /> <br />Davidson called for anyone in the audience who objected to any member of Council voting on <br />Ordinance No. 1260. <br /> <br />NONE <br /> <br />Davidson stated that this will be split into two sections: 1. Consider the rezoning issue as to whether <br />this property qualifies under the City's charter; 2. If it is found affirmative that it does qualify under <br />the City's charter, Council will consider the development itself. Davidson asked the <br />applicant's/representatives to present information only concerning with whether it qualifies for <br />rezoning. <br /> <br />Davidson opened the public hearing and called for staff's presentation as to qualification. <br /> <br />Paul Wood, Planning Director, stated that the applicant, Richmond American Homes of Colorado, <br />Inc., represented by Bernard Lash as a planning consultant, was requesting to rezone a 152.8 acre <br />parcel for the development of a residential subdivision for approximately 112 one acre lots for <br />residential development located at the northeast comer of Dillon Road and South 104th Street. The <br />request is to rezone from Industrial and CB to SF-E. SF-E in Section 17.12.01S states, "This District <br />provides low density estate lots intended for larger single family dwellings common in suburban estate <br />developments." His comments relative to the eligibility of this annexation were to forward the <br />Planning Commission recommendation. The request was presented to the Planning Commission on <br />April 17, 1997. Commission approved their Resolution No. 16, Series 1997, recommending <br />disapproval to City Council, based upon the determination that the request was not consistent with <br />the goals and policies of either the South Sub Area Plan or the rezoning criteria. Stafffound that the <br />request neither meet the rezoning eligibility requirements or principle land use policies within the <br />South Sub Area Plan. He requested that Council include, for the record, the rezoning application <br />filed by the applicant, all materials included in the City Council packet, including letters from the <br />Maple Grove Water System, Inc., Jan and Bob Ginnow, and Rocky and Jan Haight, the minutes of <br />the Planning Commission hearing on the proposed rezoning, the City zoning ordinance, the City <br /> <br /> <br />
