The items outlined in red have <br />been updated as a result of the changed and new information from the last three weeks. <br />On October 201h City Council approved Resolution No. 83 authorizing the execution of the <br />WGFP Allotment Contract. <br />Staff received communication last month that the US District Court has upheld the Record of <br />Decision and has ruled in favor of the WGFP. <br />Important Dates (as detailed in the 1/13/2021 communication) <br />• Deadline for- Petitioners t Fio ^ motion of reconsderation: , i7QO2 (a motion to reconsider was not filed) <br />• Deadline for Petitioners to file an appeal: 2/8/2021; 11 months to 2+ years delay <br />• Current Notice to Proceed (NTP) for Construction Contractor: 5/4/2021 <br />• Secure Group Financing/Bonds: 2 months (March — April) <br />• Estimated construction delay/escalation costs: $1 million/month (Louisville's prorate - $31,500/month) <br />Estimated Timeline <br />If an Appeal is not filed: <br />2/9 Special Windy Gap Meeting <br />(3-month Notice on Financing - Planned) <br />Northern to start Bonding Process <br />March March: Utility and Finance Committee Meetings <br />City Council - Temporary 2021 Funding Measures <br />Mid -April Northern Selling Bonds <br />May Construction NTP <br />2021 - 2025 Construction <br />If an Appeal is filed: <br />2/9 Further consideration <br />2021— 2022(?)
