Planning Commission <br />Meeting Minutes <br />November 12, 2020 <br />Page 5 of 10 <br />Commissioners Moline and Howe and Planner Ritchie discussed the zoning map, which <br />showed that the lots to the south and east of the proposal were also zoned Community <br />Commercial and zoned residential to the west of the application. <br />Diehl asked if Moxie currently had a liquor license that would allow them to sell liquor <br />until midnight and asked about the COVID-era in -street dining hours. <br />Ritchie and Director Zuccaro deferred to the applicant on the liquor license question and <br />replied that they did not know the limit on in -street dining hours. <br />Howe asked if staff felt that the application would negatively affect the economic <br />prosperity of the immediate neighborhood. <br />Ritchie replied that staff felt it was appropriate with the intent of downtown. She <br />acknowledged that it was immediately adjacent to residential, but staff did not find that it <br />would be any more impactful than any of the other restaurants with similar hours <br />immediately adjacent to residential. <br />Erik Hartronft, 950 Spruce Street, stated that the kitchen at Moxie was hot and crowded <br />and expressed amazement that Moxie was able to keep up business with that space. <br />He stated that the main thrust of the proposed addition was to help the applicants <br />increase their ability to serve their customers. The addition was designed to be built <br />independent of the ongoing activity to avoid disrupting the business. He stated that <br />outdoor seating was critical during COVID, as well. He then showed some of the <br />building plans for the addition, emphasizing the relationship of the addition to the <br />context of the neighborhood while meeting the functional needs of the applicant. He <br />also noted that the plan improved the drainage for the building. <br />Andy Clark, 140 Walnut in Louisville, stated that he and his wife had opened Moxie 5 <br />years ago. He shared that he had been in Boulder County for 25 years and fell in love <br />with Louisville. He stated that Moxie had outgrown that spot in year one, with 40 seats <br />and 30 regulars, meaning that they only had about 10 open spots usually, and that he <br />had trouble retaining staff due to the size limitations of the kitchen. He added that the <br />patio would give Moxie another chance at pushing through the pandemic. He explained <br />that they had withdrawn the request for amplified music after some feedback from <br />neighbors. He noted that the current hours of operation were 7:30 AM — 4 PM on <br />weekdays and — 5 PM on the weekends. Before the pandemic, they held pizza parties <br />in the backyard that had gone until 9 or 10 PM. He explained that the requested hours <br />of operation were based on what other businesses had downtown, even though the <br />likelihood of being open that late was low. He stated that it was a family place and not a <br />rowdy joint. He noted that they did not have the financial means to relocate the <br />sundeck, even if they were not trying to preserve a historic building. <br />Diehl restated his questions about the liquor licenses and the in -street dining. <br />Clark replied that Moxie had a full liquor license that extended to the back patio and <br />they served liquor on Friday nights up until 8, 9, or 10 PM, but he did not know the <br />
