104TH STREET CONNECTOR TRAIL <br />INTERGOVERNMENTAL AGREEMENT <br />BETWEEN THE CITY OF LOUISVILLE, THE <br />CITY OF LAFAYETTE, AND BOULDER <br />COUNTY <br />THIS INTERGOVERNMENTAL AGREEMENT ("Agreement"), by and between the County of <br />Boulder, a body corporate and politic of the State of Colorado ("Boulder County"), the City of <br />Louisville, aColorado home rule municipal corporation ("Louisville") and the City of Lafayette, a <br />Colorado home rule municipal corporation ("Lafayette") (each a "Party" and collectively, the <br />"Parties"), is made effective as of the date when all parties have signed it. <br />RECITALS <br />WHEREAS, the functions described in this Agreement are lawfully authorized to each of the <br />Parties which perform such functions hereunder as provided in the Constitution of the State of <br />Colorado, the Colorado Revised Statutes, as amended, and their home rule charter(s), if applicable; <br />WHEREAS, Sections 29-1-201 et seq., C.RS., as amended, as well as the home rule charters of <br />Louisville and Lafayette, authorize the Parties to cooperate and contract with one another with respect <br />to functions lawfully authorized to each of the Parties, and the people of the State of Colorado, <br />have encouraged such cooperation in contracting through the adoption of Colorado Constitution <br />Article XIV, Section 18 (2); <br />WHEREAS, the Parties have each followed the procedures required for them to enter into this <br />Agreement; <br />WHEREAS, the Jointly Owned Boulder County Lafayette -Louisville Open Space Management <br />Plan ("Management Plan") adopted by Louisville and Lafayette in January 2004, and Boulder <br />County in February 2004, describes how ten open space properties jointly owned by the Parties <br />will be managed and identifies a future trail connection opportunity between the Coal Creek Trail <br />and Rock Creek Farm via the S. 104th Street corridor that will be named the 104t' Street Connector <br />Trail ("Connector Trail"). The general location of the Connector Trail is shown on Exhibit A; <br />WHEREAS, the Management Plan identifies the County's responsibilities for the agricultural <br />tenant and wildlife management of the jointly owned properties associated with the trail <br />connection; <br />WHEREAS, the 1041h Street corridor borders four of the ten Management Plan open space <br />properties on their western boundary: Adler/Fingru, Boulder County Land Ventures, Esmail, and <br />Mayoffer 15, and there is an opportunity to connect the Coal Creek and the Rock Creek regional <br />trails via the S. 104th Street corridor by utilizing the 104th Street right-of-way or the western <br />boundaries of the four open space properties themselves; <br />WHEREAS, both Lafayette and Louisville have formally recommended construction of the 104th <br />1 <br />DocuSign Envelope ID: FAOB590D-1B04-4350-AAE4-D32E52Dlc61B <br />
