ORDINANCE NO. 1286 <br />SERIES 1998 <br /> <br />AN ORDINANCE AMENDING TITLE 17 OF THE LOUISVILLE MUNICIPAL CODE, <br />INCLUDING THE LOUISVILLE COMMERCIAL DEVELOPMENT DESIGN STANDARDS <br />AND GUIDELINES, TO SET A MAXIMUM BUILDING HEIGHT OF TWENTY-NINE <br />FEET WITHIN THE OLD TOWN COMMERCIAL COMMUNITY (C-C) ZONE DISTRICT. <br /> <br /> WHEREAS, the City of Louisville, Colorado, is a statutory <br />municipality existing under and by virtue of the laws of the State <br />of Colorado; and <br /> <br /> WHEREAS, C.R.S. §31-23-301 et seq. authorizes the City to <br />establish zoning districts and zone district regulations within the <br />City for the purpose of, among other things, promoting the general <br />welfare of the inhabitants of the City; and <br /> <br /> WHEREAS, under such authority, the City is empowered to <br />regulate and restrict, among other things, the height, number of <br />stories, and size of buildings and other structures; and <br /> <br /> WHEREAS, pursuant to C.R.S. §31-23-303(1), such zoning <br />regulations shall be made with reasonable consideration, among <br />other things, as to the character of each district and its peculiar <br />suitability for particular uses, and with a view to conserving the <br />value of buildings and encouraging the most appropriate use of land <br />throughout the City; and <br /> <br /> WHEREAS, the City Council finds it is in the best interest of <br />the City to set a maximum building height limit of twenty-nine (29) <br />feet for buildings within the Old Town Commercial Community (C-C) <br />zone district, which district is depicted on that portion of the <br />official zoning map of the City of Louisville that is attached <br />hereto as Exhibit A; and <br /> <br /> WHEREAS, the City Council finds that a maximum building height <br />of twenty-nine (29) feet within the Old Town C-C zone district is <br />necessary and appropriate to ensure that future development within <br />downtown Louisville is of a type and scope that is compatible with <br />existing buildings, including commercial, office and residential <br />buildings, within downtown Louisville and immediately adjacent <br />areas; and <br /> <br /> WHEREAS, the City Council further finds that such a maximum <br />building height is necessary and appropriate to ensure that future <br />development within downtown Louisville does not negatively impact <br />public facilities, view corridors, the rural, historical, or "small <br />town" character of downtown Louisville, and other aesthetic <br />resources; and <br /> <br />WHEREAS, the City Council further finds that such a maximum <br /> <br /> <br />
